    As a small company owner do I have to pay tax? A small company is one with income less than N25million. While you must submit your income tax returns as and when due (i.e., six months after the end of its accounting year), you would not be liable to any CIT (Company Income Tax) and VAT (Value Added Tax). A small company is also not liable to Tertiary Education Trust Fund levy. Notwithstanding, if you as a small company does not submit your income tax returns, you would be liable to a late filing penalty of ₦25,000 in the first month and ₦5,000 for every subsequent month in which the failure continues. There are currently three (3) CIT rates applicable to companies in Nigeria depending on their turnover, viz, 1) 30% for large companies with over ₦100 million turnover, 2) 20% for medium companies with ₦25 million to ₦100 million turnover, 3) and 0% for small companies with less than ₦25 million turnover.     The Law that regulates the grant of probate is dependent on the state. Hence the fee payable for grant of letter of administration varies from state to state. Upon grant of letter of administration to the administrator, 5% to 10% of the total estate of the deceased will be payable to the state government.     A written Letter of Demand to a debtor company to recover a debt owed shows a level of seriousness about the debt recovery and also serves as a pre-action notice for a debt recovery suit in court. Where the Letter of Demand has been delivered to the company, the debtor company may pay up the debt owed to avoid court actions or negotiate a debt settlement plan that will be beneficial to both the creditor and the debtor.     If you remember, on March 28 we informed you on reasons permissable for a landlord to evict his/her tenants even if they pay rent. Today, we will be focusing on how the eviction of the tenant will be carried out. A landlord cannot forcefully eject a tenant without severe repercussions regardless of how difficult the tenant might be. The tenant rights must be respected. The legal way forward is issue a quit notice\notice to quit. The duration of the notice to quit to be issued to the tenant is dependent on the type of tenancy agreement between the landlord and the tenant; 1) For weekly tenancy, 1 week quit notice 2) Monthly tenancy gets a 1 month quit notice 3) quarterly tenancy will get 3 months notice 4) And for bi annual & yearly tenancy, a 6 months quit notice is to be issued After the expiration of the notice and the tenant hasn't vacated the premises, a 7 days notice to recover the premises is to be served on the tenant by you or your agent.
