🔍 The EU's AI Code of Practice has a curious blind spot: it only addresses web scraping for copyright compliance. But what about other data collection methods? Paul Keller’s analysis reveals why limiting copyright concerns to web crawling misses the bigger picture in AI training data acquisition. Read a detailed breakdown of the third draft's implications for AI developers and copyright holders. Key insights: - The third draft of the EU's AI Code of Practice limits copyright compliance mainly to web crawling, creating a significant blind spot for other data collection methods. - This limitation means that practices like Meta's use of BitTorrent to download copyrighted books would fall outside the code's requirements, as it's not considered web crawling. - The narrow focus on web crawling contradicts Article 53(1) point(c), which requires broader copyright compliance regardless of how AI providers acquire their training data. We develop new approaches to an open internet that maximize societal benefits of shared data, knowledge and culture.
Over ons
At Open Future we shape today’s digital policies with tomorrow’s challenges in mind. We put our knowledge and experience to work along EU institutions and civil society to ensure that the principle of openness is reflected in the European Union’s digital policy framework. We believe that Europe has a mission to keep the internet open and make it better. To rebuild it, so that it is a place governed by equal opportunities, democratic access to information and respect for fundamental rights. A public space built on the idea of the commons. We work on advancing Digital Public Spaces, building Data Commons and designing the Future of Open. We do this by developing approaches to open that maximize the societal benefits of information resources. The current European policy environment provides a real opportunity to realise these objectives by enacting meaningful legislative change. At the same time we are also setting our sights on developing initiatives for the next European Commission to take up.

The EU's next Multiannual Financial Framework needs a fresh perspective. As geopolitical and economic challenges mount, we can't afford "business as usual." Key observations from Zuzanna Warso’s latest analysis: 💰 Current budget allocations are too dispersed ⚠️ Over-emphasis on “disruptive” tech vs. essential infrastructure 🎯 Need for more needs-based approach In her latest piece for Tagesspiegel Background, Zuzanna argues that member states should prioritize public infrastructure maintenance and take a more realistic approach to innovation funding. 📢 New from Open Future: A proposal for a vocabulary for machine-readable opt-outs from AI training and text/data mining. The policy brief includes: 1. The proposed vocabulary for opting out of AI training 2. A detailed paper explaining our development process “We also consider the publication of the vocabulary to be a contribution to the ongoing discussions about how machine-readable opt-outs from Generative AI training and other forms of TDM can be implemented in practice and how they can give creators and other information producers more control over how their works are used in the context of AI training.” Read the full paper & proposed vocabulary: https://lnkd.in/dZYEyAmc #ParadoxOfOpen #AITraining

🚨 A draft version of the European Parliament's Committee on Industry, Research, and Energy (ITRE) own-initiative report on technological sovereignty and digital infrastructures was published today by Contexte. The report, coordinated by MEP Sarah Knafo, a member of the far-right French party “Reconquête!”, draws its main inspiration from the European Commission's existing agenda to support European industries, which seems to gather cross-party consensus. But it also builds on a deregulation agenda largely fueled by Big Tech advocates. 👉 For our analyst Jan Krewer, the European Parliament and the European Commission should develop policies that favor credible European alternatives that work for all citizens, not just business interests. Europe needs public digital infrastructures that strengthen its resilience and do not weaken its democracy.
