It aims to: • provide a forum for young students and professionals to exchange ideas about international arbitration; • provide young professionals interested in dispute resolution with access to each other and to the international arbitration community; • promote the use of arbitration and other forms of dispute resolution by introducing new practitioners from all corners of the globe into the practice of arbitration. En esta conferencia se discutirá sobre el deber de independencia e imparcialidad del árbitro en el marco del arbitraje internacional. Young ICCA is pleased to present a panel discussion of “Arbitration and the Future of Intellectual Property Disputes” during the fourth annual California International Arbitration Week (#CIAW), on 12 March 2025. 📅 12 March 2025 🕑 16:30 (PDT) 🌎 W Hotel, 930 Hilgard Avenue, Los Angeles, United States ✍ https://lnkd.in/dMv64xJ5. Parties frequently opt for #arbitration where confidentiality is a concern, and arbitration can be attractive to parties in disputes involving intellectual property, technology, and life sciences, all of which are cornerstones of California’s economy. Jurisdictional rules often limit what is arbitrable, and parties have taken to including IP “carve-out” provisions in their contracts. More recently, however, a global trend in favor of the arbitrability of intellectual property disputes has seen a decline in the use of “carve-out” provisions and an increase in the number of intellectual property-related matters brought to arbitration. This event will bring together a panel of diverse professionals working at the intersection of arbitration and intellectual property to discuss: (1) the varied nature of intellectual property disputes, from infringement actions to breach of contract claims; (2) the worldwide trend toward arbitrability and arbitration of intellectual property disputes; and (3) the advantages and disadvantages of arbitration for parties to such disputes. The panel will be moderated by Young ICCA Co-Chair Eva Chan and will include Thomas Walsh (Partner, Freshfields), Rina See (Barrister, Bankside Chambers), and Giorgio Sassine (Associate, Musick Peeler; Secretary of the Board of California Arbitration (CalArb)). The post-event report for the Young ICCA workshop on cross-examination, held on 4 October 2024 in #Tallinn, is now available. The workshop was documented by Maria Pihlak and Ruxandra Irina Esanu and the full report is available on the Young ICCA website: https://lnkd.in/e5Ae6x9y. The workshop, hosted by Sorainen, as part of the inaugural Tallin #Arbitration Day, was a a great opportunity for students and arbitration practitioners to enhance their cross-examination skills and gain insights from arbitration experts. 🧑⚖️ Participants had the chance to: 🔹 Engage in panel discussions with industry veterans on techniques and strategies for effective cross-examination. 🔹 Take part in a practical, hands-on mock case, where they performed cross-examinations and received valuable feedback. Explore civil vs. common law approaches to witness testimony and learn key tips on preparation and execution. Join us in São Paulo on 12 March 2025 for a Skills Training Workshop on Cross-Examination of Experts! 📅 12 March 2025 🕑 14:00 - 21:30 (UTC-03) 🌎 São Paulo ✍ https://lnkd.in/dREJfECr Cross-examination is one of the most difficult skills for young practitioners to develop. This in-person workshop provides an opportunity to learn from both legal practitioners as well as damage experts involved in international arbitration, as well as conduct mock cross-examinations with leading experts before a live tribunal and receive feedback. Participants will be arranged into teams to analyse mock damages expert reports and prepare cross-examination outlines. On the day of the workshop, the event will begin with a one-hour+ panel from leading practitioners followed by another one-hour+ panel from leading experts providing guidance on how to conduct and perform an effective cross-examination. Counsel teams will then have an opportunity to cross-examine the opposing side’s experts before a live tribunal and receive live feedback.
