📚 Available Now: ICCA Yearbook Commercial Arbitration 2025 – First update. The first upload of materials for the 2025 volume of ICCA’s Yearbook Commercial Arbitration is available in the Wolters Kluwer: International Arbitration & Mediation database, featuring 30 court decisions from 8 countries. 𝗛𝗶𝗴𝗵𝗹𝗶𝗴𝗵𝘁𝘀 𝗶𝗻𝗰𝗹𝘂𝗱𝗲: ◾ A decision by the French Cour de Cassation affirming the lower court’s decision to deny recognition of the ad hoc interim arbitral award on jurisdiction in the Sulu case, emphasising the choice of arbitrator as an essential element of the arbitration clause. ◾ Moldovan Supreme Court rulings favouring the enforceability of foreign arbitral awards, notably the decision in Komaksavia Airport Invest Ltd v. the Government of the Republic of Moldova, which upheld asset attachment as a protective measure in aid of enforcing arbitration awards. ◾ Updates from the UAE, including decisions from Dubai and Abu Dhabi courts upholding the enforceability of foreign arbitral awards, with a notable 2024 decision by the Dubai Court of Cassation addressing the curability of formal defects in arbitral awards. ◾ A UK Court of Appeal’s decision regarding the registration of two ICSID awards against Spain and Zimbabwe, clarifying the applicability of the UK State Immunity Act in enforcement proceedings and the express waiver of immunity in Article 54 of the ICSID Convention.
