EDPB Report on First Review of EU-US Data Privacy Framework The European Data Protection Board (EDPB) has conducted its first review of the European Commission's adequacy decision on the EU-US Data Privacy Framework (DPF). This report examines both commercial aspects and government access to data under the new framework, which replaced the invalidated Privacy Shield. While acknowledging improvements, the EDPB identifies several areas requiring ongoing monitoring and clarification to ensure an essentially equivalent level of data protection.

GDPR Administrative Fines Guidelines The European Data Protection Board (EDPB) has adopted guidelines to harmonize how supervisory authorities calculate administrative fines for GDPR violations. These guidelines complement previous guidance on when to impose fines, focusing instead on the methodology for determining fine amounts. The guidelines aim to ensure fines are effective, proportionate and dissuasive in each case, while staying within the legal maximums set by the GDPR. They outline a five-step process for calculating fines, considering factors like the nature and gravity of the infringement, any mitigating or aggravating circumstances, and the size of the organization involved.  -- Signatu revolutionises Consent Management. EDPB Opinion on 'Consent or Pay' Models for Large Online Platforms The European Data Protection Board (EDPB) has issued an opinion on the validity of 'consent or pay' models implemented by large online platforms for behavioral advertising. This opinion provides guidance on how such models can comply with GDPR requirements for valid consent, particularly that it be freely given. The EDPB emphasizes the need for platforms to offer genuine choices to users, including free alternatives without behavioral advertising in most cases. Signatu revolutionises Consent Management.
