The High Court has approved a $4 million settlement of a proceeds of crime case in which the Police sought to forfeit profits allegedly made through health and safety breaches. The settlement comes one week into what was due to be a seven-week hearing, in which the Commissioner sought recovery of up to $11 million from Salters Cartage Ltd, the two shareholders and associated trusts. The Salter case represents a new approach to health and safety liability in New Zealand. Energy Minister Simeon Brown issued a Government Policy Statement (GPS) to the Electricity Authority concerning the electricity industry, with a particular focus on updating the wholesale electricity market and security of supply. According to Minister Brown, the GPS sets the Government's "expectation that the Electricity Authority will drive a more competitive, fuel agnostic, electricity sector that works in the long-term interests of consumers to avoid excessive prices". The Government has confirmed that policy decisions on modernising the Public Works Act are expected to be announced by the end of the year, with the Public Works Act Amendment Bill set to be introduced to Parliament in mid-2025. The Bill aims to make it simpler to acquire land needed for critical infrastructure by improving processes, and planning around connected projects at both a central and regional level. However, beyond that further details have not been released. Also yet to be released is the independent expert advisory panel's report which has identified a number of instances where the Act lacks clarity and commonsense, and therefore (we assume) will be subject to proposed legislative reform. The report's eventual public release is eagerly anticipated.
