The same day as EURO 2024 ⚽️ started I had the pleasure of watching Scottish fans preparing 🍺🥳 and attend the Industry Patent Quality Charter (IQPC) conference🤓. It was a great day! You have probably seen more of Scottish fans than the IQPC conference, I hope😰 The conference exceeded all my expectations in terms of the content of the presentations and networking. My personal takeaway is that the decreasing quality of the granted patents from EPO which has been verified subjectively by corporate and attorneys (and examiners at EPO) for a while and now objectively by numbers and court decisions. The courts don’t use granted EP patents for an injunction if they have not survived at least an opposition or BoA. So, the more granted patents in combination with that opposition can provide an injunction strength to a patent has lead to: ✅ Less oppositions because of the time and costs to handle more patents ✅ Less oppositions because you don’t want to give your competitors stronger patent rights in case they survive the opposition The lowered number of oppositions and BoA cases was shown during the conference. Are there other reasons, implications or impacts between lower grant quality and less oppositions🤔, if you have any thoughts then feel free to comment.
