Like our colleagues at Founders Law, we are very intrigued to see what the new government will do with regard to the changes to unfair dismissal requirements that they have promised, and how it affects the process during probation. Watch this space!
So. according to the Financial Times, Labour’s plan to introduce day 1 unfair dismissal rights will be subject to employers being able to keep new hires on probation for up to six months. I imagine businesses will be immediately amending their template contracts to increase their probation periods if they don’t currently have this provision or use a shorter length! I am intrigued to see what the draft Bill actually says around what will be required for a fair dismissal during those 6 months. In particular, will a formal process need to followed and how much opportunity to improve/training will need to be offered if there are performance concerns. I suspect the draft Bill will not include much detail around this either, but I will keep you posted if/when more information becomes available. #employmentlaw #unfairdismissal #probation

As September comes to a close, we’re taking a moment at Founders HR to reflect on what an incredible month it’s been! Here’s a glimpse of what we’ve been up to... 💳 It all started with the inaugural CFO Forum, engaging with some of the UK’s brightest CFOs to discuss all things finance within the startup ecosystem. 🚀 Then it was off to Tech Nation's launch of their next #FutureFifty cohort at Daylesford Organic in the Cotswolds, where our Founder Tracy Davies co-hosted a roundtable on "Scaling Your Culture as You Grow" (and we even got to witness Richard Browning take flight!). 📈 Next, we headed to the #Upscale event at The Century Club in Soho to meet the latest cohort of the UK’s most promising startups. This program is tailored for ambitious founders and their leadership teams, with a strong focus on gearing up for Series B investment - the room was buzzing! 🎉 We were excited to join Tech Nation's #Creo cohort at the Royal College of Surgeons, celebrating disabled founders and innovators working in the disability space. 🇬🇧 At the #GovTech reception in Mayfair, we marked a significant moment for the public and private sectors' collaboration through tech, where Founders Forum Group also announced the relaunch of The GovTech Summit in partnership with PUBLIC. 💸 And finally, we saw the future of venture capital take shape at the official launch of the new Founders Forum Group VC Summit, held at the iconic Christie’s London. From 26 October 2024, employers must proactively take “reasonable steps” to prevent the sexual harassment of their staff at work. The new duty under the Worker Protection (Amendment of Equality Act 2010) Act 2023 is a seismic change in UK discrimination law. It seeks to put strict obligations on employers to prevent sexual harassment from taking place. The duty requires employers to take reasonable steps to prevent sexual harassment against its workers by other workers. It is also “preventative” which means that employers should not wait for an incident to occur before taking action. You must take active, reasonable steps which requires anticipating potential incidents, reviewing policies and educating staff, identifying risk areas including review of past incidents and looking at investigative, reporting and recording processes as well as ensuring that perpetrators are dealt with robustly. Australians now have the "Right to disconnect" - and it seems the UK are close behind...
NEWS ALERT! Australia has now introduced the "right to disconnect' law, giving employees the right to disconnected from work communications after hours, in a bid to improve work-life balance and mental health. Under this legislation, Australians can now legally ignore calls and emails from their bosses after office hours without facing any repercussions. Despite being met by mixed reactions and criticised for being "rushed through", the decision follows a global trend, with countries like France, Germany, and Italy already implementing similar measures. 🇬🇧 In the UK, the conversation around the right to disconnect is gaining traction. The UK government is exploring options for introducing similar legislation as part of its commitment to modernising workers’ rights. Consultations are underway, drawing inspiration from models in Belgium and Ireland, where the right to switch off has been incorporated into national labor laws. Although no law has been passed yet, the Labour Party has promised to address this issue in future employment rights reforms, particularly in response to the growing prevalence of hybrid work. Why does everybody hate HR? A well-functioning HR department can bring incredible value to a business. Many entrepreneurs rightly claim, "People are my most important asset"... so having a strong People team to manage this asset is crucial. So, why the negativity towards HR? A recent article from The New York Times highlights that HR teams remain unpopular in many companies, regardless of the industry... which in turn is making your HR teams themselves miserable. “People in HR tend to be very compassionate, very empathetic,” said Hebba Youssef, the Chief People Officer at Workweek. “But a lot of employees look at us as inherently evil.” Harsh? Perhaps. And often unfair (partially because of visibility - people notice when HR handles layoffs - but not when we fight to save jobs!) . However there are some common misconceptions behind it: 👿 HR is seen as the corporate "police." 👿 There’s a focus on compliance and process over understanding the business. 👿 Endless forms and lengthy employee policies. 👿 Mandatory, cumbersome processes. 👿 An inclination for telling you what you can’t do. It’s time to shift this perception. As HR professionals, we need to actively demonstrate the value we bring - not just to business leaders but to all stakeholders - and provide a tangible impact.
