The duty of disclosure in financial remedy proceedings (arising on divorce) is unequivocal, and for good reason. However, we often see (and experience first-hand) judgments reflecting the difficult position a compliant spouse and the court find themselves in when faced with a serial non-discloser. A recently published case highlighted once again these difficulties and shows the tools the court has in its arsenal to best manage such a situation. In finding that the time for appealing an arbitration award had expired, the Court has made clear that the Arbitration Act 1996 distinguishes between the date an award is made and the date the award is notified to the parties. Partner Jon Gillow led on deal supported by associate James McCarthy. Operation Europe has been delivering special interest tours to an international B2B customer base for 40 years. We're delighted to have advised Olympic athletes Rebecca Adlington and Steve Parry on the successful management buyout (MBO) of Swim!, the swimming lessons business they first founded in 2012.
