END-USER LICENSE AGREEMENT (EULA)
IMPORTANT - READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Team Eonian ("Licensor") for the use of the Symphony of Souls ("Software"). By installing or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
1. LICENSE GRANT
Licensor grants you a non-exclusive, non-transferable, revocable, limited license to use the Software solely for your personal, non-commercial use.
2. OWNERSHIP
The Software and any accompanying documentation are owned by Licensor or its licensors and are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Licensor retains all rights not expressly granted to you in this EULA.
3. RESTRICTIONS
You may not, without the prior written consent of Licensor: (a) copy or reproduce the Software; (b) modify, adapt, translate, or create derivative works based on the Software; (c) sell, rent, lease, distribute, or sublicense the Software; (d) reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits such activity; (e) remove or modify any proprietary notices or labels on the Software or accompanying documentation; or (f) use the Software for any unlawful purpose.
4. WARRANTY DISCLAIMER
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
5. LIMITATION OF LIABILITY
LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00).
6. TERMINATION
This EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must immediately cease using the Software and destroy all copies of the Software in your possession.
7. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of British Columbia, without giving effect to any principles of conflicts of law.
8. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Licensor.
