This Privacy Policy applies to ActPass Service and other related services provided by Artal Internet FZ-LLC (hereinafter "Artal Internet FZ-LLC" or "Us" or "We"), which we here collectively call the “Service”. We may periodically update this Privacy Policy by posting a new version on www.actpass.com. If we make any material changes, we will notify you as required under applicable law, including by posting such change prior to the change becoming effective.
In this Privacy Policy, "Personal Information" or “Personal Data” means information about you, the Data Subject, which can be used to identify you either directly or indirectly. This information includes but not limited to your name, e-mail address, phone number, payment details, purchase history, and digital (IP) computer address.

3. WHO CAN SEE YOUR DATA
Apart from us, your data can be accessed by others in the following situations:
(1) Other players and users.
If you use our game services, other players and users of such game may, for example, see your profile data, in-game activities and read the messages you have posted.
(2) Our service providers.
We have vendors who help us to provide the Service. These vendors process your data only at and according to our instructions to provide the Service, and perform tasks (i.e. user support, advertising, analytics).
(3) Other companies and public authorities.
In order to verify payments and illegal activity, we may process and disclose data with other companies, organizations and provide it to public authorities in response to lawful requests.
We may also disclose your data based on your consent, to comply with the law or to protect the rights, property or safety of us, our users or others.
4. RETENTION PERIOD
We will only use, retain your Personal Data as long as necessary to fulfil the purposes for which the information is collected and processed (or where the applicable law provides for longer storage and retention period, for the storage and retention period required by law). After that your Personal Data will be deleted, blocked or anonymized, as provided by applicable law

If you play the games provided by the third party game service providers on ActPass, they may access your data and operate under their own privacy policies. They may access your data (such as real name, unique personal identifier, online identifier, IP address, e-mail address, account name (ID), or other similar identifiers) to provide game services.
(3) Required Disclosures.
We will disclose personal information when we believe in good faith that disclosure is required or permitted by law (e.g., court order or subpoena) or such disclosure helps (i) enforce our Terms of Services or other relevant policies, or (ii) protect the safety and security of our users, employees and third parties, or the integrity of our Services.
(4) Mergers and Corporate Transactions.
In the event that we undergo a business transition, such as a merger, acquisition, joint venture, corporate divestiture or dissolution, a sale of assets, or similar transactions, we may share, disclose or transfer your information, including personal information, to the other organizations that are parties to such transactions.
(5) With Your Permission.
Additionally, if you opt-in or otherwise agree to have your information shared with a third party (or third parties), we will share your information accordingly, in which case the third party's use of your information is subject to the third party's own privacy policy.
We may use de-personalized information in any way, including sharing it with third parties, without your consent. Among other things, we may share some of the information we collect from you upon installing a mobile application with vendors and other service providers who are working with us in connection with the operation of Our Services and/or for analytics purposes which may require the reproduction and display of de-personalized information. You may be able to "opt out" of the collection of your information for third party analytics purposes by following the directions provided by our third party analytics vendor. If you "opt out" with one third party analytics provider, that action is specific to that provider only and does not otherwise limit our information collection under the terms of this Privacy Policy.
6. INTERNATIONAL DATA TRANSFERS
As our Service is global by nature, your use of the Service may also involve the transfer, storage, and processing of your personal information to other countries; such as Switzerland. We will take appropriate measures, in compliance with applicable law, to ensure that your personal information remains protected.
7. YOUR RIGHTS AND OPTIONS
Note: To protect your privacy, we may also take additional steps to verify your identity before fulfilling your request, such as by requesting you provide us your email address, phone number, or asking you to answer questions regarding your activities on our Services.
(1) Opt out of marketing emails and other direct marketing.
You may opt out of receiving promotional communications, such as marketing emails from us by following the instructions in such communications, or by changing in-website setting. The updated settings may not be effective immediately. Note that you may still continue to receive non-promotional communications from us, such as communications regarding the Service or updates to our Terms of Services, Privacy Policy, other relevant policies.
(2) Push Notifications
We may send you push notifications through our mobile applications. You may at any time opt-out from receiving these types of communications by changing the settings on your mobile device.
(3) Opt-out of targeted advertising.
You can opt-out of interest-based advertising on mobile applications by changing the settings on your mobile device, PC, other devices to use our Services.
(4) Right to Access.
You have the right to request any of the personal information we hold on you. You can do this by sending an email to support@actpass.com and asking for your information. We will provide this information to you within [10] business days from we received your request. Your information will be sent to you in a computer readable format, unless another reasonable format is requested. Please note it may be taken more time upon type of format.
(5) Right to Correction.
You can request correction of your personal information where it is inaccurate. You can do this by sending an email to support@actpass.com. And in some cases, we may provide self-service tools, that enable you to update some of your personal information.
(6) Right to Be Forgotten.
Where you gave us your consent to use your information for a limited purpose, you can contact us to withdraw that consent, though this will not affect any processing that has already taken place before that time. When you make these requests, we may need time to investigate and facilitate your request. If there is any delay or dispute as to whether we have the right to continue using your information, we will restrict any further use of all your related information until the request or the dispute is resolved. To delete your account or request that we no longer use your information to provide you Services, contact us at support@actpass.com; we will respond to your request within [10] business days.
Note: In some cases, we may not be able to delete your personal information and will retain and use our information as long as necessary to comply with our legal obligations, resolve disputes. If you delete your account, you will permanently lose access to our Services.
(7) Right to Restriction of Processing.
You may make temporary suspension to process your personal information in case of the disputes over the accuracy of information and the legality of information processing. You can do this by sending an email to support@actpass.com.
(8) Right to Data Portability.
You may request to provide or transfer the information. You can do this by sending an email to support@actpass.com.
(9) Right to Object.
You may suspend processing of your personal information if such personal information is used for the purpose of direct marketing, reasonable interests, the exercise of official duties and authority, and research and statistics. You can do this by sending an email to support@actpass.com.
(10) Right to Automated Individual Decision-Making, Including Profiling.
You may request to cease the automated treatment of personal information, including profiling, which has critical impact or cause legal effect on them. You can do this by sending an email to support@actpass.com.
8. COOKIES
We may collect collective and impersonal information through cookies or other similar technologies. Cookies are small text files stored on the user's end device when you visit our website to use Services. They allow the user to be recognized when visiting the website again and for the content shown to be optimized.
9. SECURITY OF YOUR INFORMATION
We implement reasonable security measures to protect the security of your information and also continuously update our technology with the goal of better protecting your information. Although we take reasonable precautions against possible security breaches, we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will not occur. If we become aware of any issues for security of your personal information has occurred, we will notify you such issues within 72 hours. We urge you to take steps to keep your personal information safe, to use strong passwords, to log out of your account after use, and to use different passwords for different services with different companies. It is important that you also help protect and maintain the security of your account. Please notify us immediately of any unauthorized use.

Protecting minor’s privacy is very important to us. Our Services are not directed to the person under 18 (or other age as required by local law), and we do not knowingly collect personal data from minors.

12. AUTOMATED DECISION MAKING
We do not make decisions that may affect you based solely on automated processing of your personal data. All decision-making processes related to the processing purposes described above are carried out with human intervention.
13.CHILDREN’S PERSONAL INFORMATION
We do not collect Personal information of children under the age of 18, or equivalent minimum age depending on jurisdiction without parental consent from their parents or legal guardian. Therefore, before being able to use our services, we will ask you to provide age-related information in order to help us comply with data protection laws. 2. Use of personal information
We may use (and may have used during the 12-month period prior to the effective date of this Privacy Policy) the categories of personal data described in the section “WHY DO WE COLLECT YOUR DATA” in the Privacy Policy and for the following business purposes:

We do not sell your personal data to third parties. However, we may share (a) your cookie information and advertising identifiers with our third-party advertising platforms to deliver interest-based advertisements, attribute installs and optimize campaign performance; share (b) your personal information with third party game service providers who are providing the services of their games on ActPass. These third party partners may access your data and operate under their own privacy policies. We encourage you to check their privacy policies to learn more about their data processing practices. And to the extent that practice is considered a “sale” under the CCPA, you may opt out of said sharing by following the steps described in “Opt-out of targeted advertising” in the Privacy Policy. And we do not have actual knowledge of any sale of personal data of minors under 16 years of age, as the term “sale” is defined under the CCPA.

5. USE OR DISCLOSURE OF SENSITIVE PERSONAL INFORMATION
We do not use or disclose your sensitive personal information.
6. YOUR RIGHTS and choice
(1) Right to Know and Data Portability
You have the right to request that we disclose certain information to you about our collection, use, sale or sharing of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you:

(2) Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.
(3) Exercising Your Rights to Know or Delete
To exercise your rights to know or delete described above, please submit a request by:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.
You may also make a request to know or delete on behalf of your child by submitting the sufficient information what we requested to verify your relationship with the child.
You may only submit a request to know twice within a 12-month period. Your request to know or delete must:
·Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
·Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
You do not need to create an account with us to submit a request to know or delete. We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

(4) Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact support@actpass.com.
We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
(5) Personal Information Sales Opt-Out and Opt-In Rights
If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

You do not need to create an account with us to submit a request to know or delete. We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

(4) Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact support@actpass.com.
We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
(5) Personal Information Sales Opt-Out and Opt-In Rights
If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by visiting our internet web page (www.actpass.com):

We will not discriminate against you for exercising any of your rights. Unless permitted by the applicable laws, we will not:
·Deny you goods or services.
·Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
·Provide you a different level or quality of goods or services.
·Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the applicable law (such as CCPA, CPRA) that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
(7) Other California Rights
·Shine the Light: California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.
·Do Not Track: Some web browsers transmit “do-not-track” signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
