END USER LICENCE AGREEMENT (EULA)
This End User Licence Agreement ("Agreement") is a legal agreement between you ("User" or "Developer") that governs your use of the software application provided by the Developer.
By installing, copying or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
Grant of licence
The Developer grants you a non-exclusive, non-transferable, revocable licence to use the Game for your personal, non-commercial use in accordance with the terms of this Agreement.
Restrictions
You may not:
a. Copy, modify or distribute the Game;
b. Reverse engineer, decompile or disassemble the game;
c. Rent, lease or lend the Game;
d. Use the game for commercial purposes;
e. Remove or alter any proprietary notices or labels on the game.
Ownership
The game is licensed, not sold. The Developer retains all right, title and interest in and to the Game, including all intellectual property rights. This Agreement does not grant you any ownership rights in the Game.
Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you must stop using the Game and delete all copies of the Game.
Disclaimer
The Game is provided "as is" without warranty of any kind. The Developer disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
In no event shall the Developer be liable for any special, incidental, indirect or consequential damages arising out of the use or inability to use the Game, even if the Developer has been advised of the possibility of such damages.
Governing law
This Agreement shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
Severability Clause
If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between you and the Developer regarding the use of the Game and supersedes all prior agreements and understandings, whether written or oral, with respect to the subject matter here of.
