End User License Agreement (EULA)
IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT (THE "AGREEMENT") CAREFULLY BEFORE INSTALLING, COPYING OR USING THIS SOFTWARE.
This Agreement is a legal contract between you ("User") and Novar Spark Interactive ("Developer") that sets forth the terms and conditions for the use of the software product, DevTycoon ("the Software"). By installing, copying or using the Software, you agree to be legally bound by the terms of this Agreement. If you do not agree to these terms, do not install, copy or use the Software.
1. Grant of License
Novar Spark Interactive grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use one copy of the Software solely for your personal, non-commercial use, subject to the terms of this Agreement.
2. Restrictions on Use
The User agrees NOT to perform the following actions:
2.1 Modification or Reverse Engineering:
You may not decompile, disassemble, reverse engineer, modify, translate or create derivative works based on the Software or any part thereof.
2.2 Unauthorized Distribution:
You may not copy, distribute, share, rent, lease, loan, sublicense or transfer the Software to any third party without the prior written consent of the Developer.
2.3 Sale or Commercial Use:
You may not sell, resell, market or use the Software for commercial purposes, except as expressly authorized in writing by the Developer.
2.4 Illegal or Unauthorized Use:
You may not use the Software for illegal activities, piracy or other purposes that infringe applicable laws or the rights of the Developer.
2.5 Circumvention of Security Systems:
You may not circumvent, disable or interfere with the security systems, copy protection or protection mechanisms of the Software.
3. Intellectual Property
The Software, together with all copyrights, trademarks, trade secrets and other intellectual property rights related thereto, are the exclusive property of Novar Spark Interactive. This Agreement does not grant you any ownership rights in the Software, only a limited license to use it on the terms described herein.
4. Limitation of Liability
The Software is provided "AS IS", without warranty of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall Novar Spark Interactive be liable for any indirect, incidental, special, consequential or punitive damages related to the use or inability to use the Software.
5. Termination of Agreement
This Agreement will automatically terminate if you breach any of the terms set forth herein. Upon termination of this Agreement, you must uninstall and delete all copies of the Software in your possession.
6. Jurisdiction and Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of the country in which the Developer resides. Any disputes shall be resolved exclusively in the courts of such jurisdiction.
7. Acceptance of Terms
By installing, copying or using the Software, you acknowledge that you have read and understood this Agreement, and that you agree to abide by its terms and conditions.
