End User License Agreement (EULA)

1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Amped Horizon e.U. ("Company", "We", "Us", or "Our") for the use of AI Pals Engine ("Software"). This EULA incorporates by reference our Acceptable Use Policy ("Policy "), which outlines prohibited uses of the Software. By installing, accessing, or using the Software through the Steam platform, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, access, or use the Software.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Software, strictly in accordance with the terms of this EULA and Steam's Subscriber Agreement.
3. Restrictions
Your use of the Software must comply with applicable laws and regulations (including trade compliance laws and regulations) and adhere to the Acceptable Use Policy:
Acceptable Use Policy (“Policy”)
Prohibited Uses
We want everyone to use the Software safely and responsibly. You agree not to, and you will not permit others to:
I. Generate any content, including the outputs or results generated by any Model or Model Derivatives, that infringes, misappropriates, or otherwise violates any individual's or entity's rights (including, but not limited to rights in copyrighted content).
II. Perform or facilitate dangerous, illegal, or malicious activities, including:
a. Facilitation or promotion of illegal activities or violations of law, such as:
i. Promoting or generating content related to child sexual abuse or exploitation;
ii. Promoting or facilitating sale of, or providing instructions for synthesizing or accessing, illegal substances, goods, or services;
iii. Facilitating or encouraging users to commit any type of crimes; or
iv. Promoting or generating violent extremism or terrorist content.
b. Engagement in the illegal or unlicensed practice of any vocation or profession including, but not limited to, legal, medical, accounting, or financial professional practices.
c. Abuse, harm, interference, or disruption of services (or enable others to do the same), such as:
i. Promoting or facilitating the generation or distribution of spam; or
ii. Generating content for deceptive or fraudulent activities, scams, phishing, or malware.
d. Attempts to override or circumvent safety filters or intentionally drive any Model or Model Derivatives to act in a manner that contravenes this Policy.
e. Generation of content that may harm or promote the harm of individuals or a group, such as:
i. Generating content that promotes or encourages hatred;
ii. Facilitating methods of harassment or bullying to intimidate, abuse, or insult others;
iii. Generating content that facilitates, promotes, or incites violence;
iv. Generating content that facilitates, promotes, or encourages self harm;
v. Generating personally identifying information for distribution or other harms;
vi. Tracking or monitoring people without their consent;
vii. Generating content that may have unfair or adverse impacts on people, particularly impacts related to sensitive or protected characteristics; or
viii. Generating, gathering, processing, or inferring sensitive personal or private information about individuals without obtaining all rights, authorizations, and consents required by applicable laws.
III. Generate and distribute content intended to misinform, misrepresent or mislead, including:
a. Misrepresentation of the provenance of generated content by claiming content was created by a human, or represent generated content as original works, in order to deceive;
b. Generation of content that impersonates an individual (living or dead) without explicit disclosure, in order to deceive;
c. Misleading claims of expertise or capability made particularly in sensitive areas (e.g. health, finance, government services, or legal);
d. Making automated decisions in domains that affect material or individual rights or well-being (e.g., finance, legal, employment, healthcare, housing, insurance, and social welfare);
e. Generation of defamatory content, including defamatory statements, images, or audio content; or
f. Engaging in the unauthorized or unlicensed practice of any profession including, but not limited to, financial, legal, medical/health, or related professional practices.
IV. Attempt to circumvent, disable, or manipulate the Software guard system or any related files designed to ensure responsible use and prevent harm. This includes but is not limited to modifying code, exploiting vulnerabilities, sharing information or techniques that could be used to bypass or weaken these safety mechanisms, or interfering with safety protocols.
V. Utilize any AI models within the Software that:
a. Were exclusively trained or fine-tuned on illegal content. This includes, but is not limited to, datasets consisting predominantly of illegal material or hate speech.
b. Lack appropriate safety measures or fail to include guardrails to prevent harmful or unethical outcomes.
Please report any violation of this Policy, software “bug,” or other problems that could lead to a violation of this Policy through one of the following means:

4. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate immediately and automatically without any notice from the Company if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession or control.
5. Updates and Modifications
We may update or modify the Software and this EULA at any time. Continued use of the Software after any such changes shall constitute your consent to such changes. If you do not agree to the changes, you must stop using the Software and uninstall it.
6. Intellectual Property Rights
The Software, including but not limited to its software code, graphics, characters, music, sound effects, and documentation (collectively " Software Content"), is protected by copyright, trademark, trade secret, and other intellectual property laws. All rights, title, and interest in and to the Software Content are owned exclusively by the Company or its licensors.
You acknowledge that you do not acquire any ownership rights in the Software Content by using the Software. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the Software Content without the Company’s prior written consent.
You agree to abide by all applicable copyright and intellectual property laws in your use of the Software.
Any user-generated content (UGC) must comply with this EULA and the Acceptable Use Policy.
7. Disclaimer of Warranties
The Software is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by applicable law, the Company disclaims all warranties, whether express, implied, or statutory, including, but not limited to:
a. Merchantability: The Software being fit for its ordinary purpose.
b. Fitness for a Particular Purpose: The Software meeting specific requirements communicated to the Company.
c. Non-infringement: The Software not infringing on any third-party intellectual property rights.
d. Accuracy, Completeness, or Reliability: The information and content within the Software being free from errors or omissions
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use the Software, including but not limited to:
a. Direct Damages: Losses that are a direct and foreseeable result of using the Software.
b. Special, Incidental, Indirect, or Consequential Damages: Losses that are not directly caused by the Company's breach but arise as a consequence (e.g., lost profits, loss of data).
c. Punitive Damages: Damages intended to punish the Company for wrongful conduct.
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be resolved in the courts of Austria.
10. Severability
If any provision of this EULA is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. Such provision shall be modified to reflect the parties' intention as closely as possible, while still being enforceable.
11. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of rights must be in writing to be enforceable.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this EULA or your use of the Software, including, but not limited to, user-generated content.
