With over three decades of history, the Thai Arbitration Institute (TAI) is one of Thailand's leading arbitral institutions, having administered disputes totalling over THB 1 trillion as of 2020. Known for its neutrality and independence, TAI operates under the Office of the Judiciary with government funding, enabling it to provide administrative services without charging institutional fees – offering significant cost savings to parties.   Committed to staying current with developments in arbitration, TAI has regularly updated its Arbitration Rules of 2017. The Fourth Amendment (2021) to the TAI Arbitration Rules introduced expedited procedures for disputes where parties so agree or where claims do not exceed THB 5 million. Thailand has incorporated international maritime principles into its Arrest of Ship Act B.E. 2534 (1991) ("Act"), despite not being party to major maritime arrest conventions. A critical challenge under this Act is the requirement that maritime creditors must have Thai domicile to apply for ship arrest. This requirement creates significant obstacles for foreign creditors seeking security for maritime claims against vessels in Thai ports. Our Partner, Ittirote Klinboon (with the assistance of Counsel Rawi Meckvichai and Senior Associate Toon Thanakham) examines potential solutions for foreign creditors in a recent client update, including claim assignment and domicile establishment strategies, while acknowledging these approaches remain untested before Thailand's Supreme Court. With effect from 20 March 2025, insurance companies will be able to introduce a copayment clause that will apply to health insurance policy renewals and new policies. The insurance industry in Thailand is undergoing this significant transformation in March 2025 due to rising health insurance premiums, medical inflation, and unnecessary medical expenses. The copayment policy was developed by Thailand’s Office of Insurance Commission ("OIC") in collaboration with the insurance sector, under the New Health Standard pursuant to OIC Order No. 14/2564 RE: Criteria for Approval of Standard Forms and Wording of Health Insurance Riders for Life Insurance Companies and OIC Order No. 15/2564 RE: Criteria for Approval of Standard Forms and Wording of Individual Health Insurance Policies for Non-Life Insurance Companies ("OIC Orders"), which have been in effect since November 2021. To control rising medical costs and reduce unnecessary claims that impact premium rates, the OIC Orders have introduced the development of alternative health insurance products to manage healthcare expenses while safeguarding insured rights. The key measures include: 1. developing alternative health insurance products to reduce unnecessary medical expenses; and 2. encouraging self-medication for minor illnesses or obtaining prescriptions to purchase medicine directly from pharmacies. The copayment policy is a targeted solution designed to address these concerns. This claims model aims to slow down premium increases and ensure the long-term sustainability of voluntary health insurance. Shipping Practices in Thailand: Key Insights 🚢 The second half of 2024 saw much activity in the shipping and international trade industry. Apart from market developments, jurisdictions in Southeast Asia region have enacted changes to their legislative and regulatory framework, and have set out initiatives in their respective policy roadmaps. The courts have also seen significant cases being decided, impacting on the state of admiralty and maritime law. Our partners Saroj Jongsaritwang, KRIDA PHOONWATHU and Ittirote Klinboon along with Counsel, Rawi Meckvichai recently contributed their insights to our Regional Shipping Update highlighting some of the key developments in Thailand (with the assistance of Partner Jantapa Erjongmanee, Senior Associate Toon Thanakham and Associate Pimpawee J.). The key developments include in the area of legislation and regulation as well as in the area of policy. In Thailand, the legislation has introduced new requirements regarding the minimum ratio of Thai seafarers onboard Thai-flag vessels. In the area of policy, shipping regulators have been observed to be setting out clearer directions in their initiatives and areas of focus.  For Thailand, the country’s largest deep-sea port is undergoing the third phase of a major expansion.
