⚖️ ANK Law Office Successfully Protected Ukrferry in the Supreme Court 🚢 🔹 ANK team represented the Shipping Company "Ukrferry" in the Supreme Court, successfully resolving a lengthy dispute related to the only rail ferry complex in Ukraine. 📅 In January 2021, LLC "AUTOLOGISTIKA" (an international freight forwarder specializing in the transportation of new vehicles on taxi-cars 🚗) submitted a claim against Chornomorsk Sea Port and the Ministry of Infrastructure, asking the court to oblige the Port to renew rendering services under the Agreement. ⚖️ Later, the Port and the Ministry submitted counterclaims, requesting the court to recognize the Addendum to the Agreement as null and void due to exceeding powers and containing elements of the lease contract. 📝 🌍 As the subject of the Addendum involved the use of the ferry complex at Chornomorsk Sea Port, the court engaged the Shipping Company "Ukrferry" in the case, as Ukrferry acts as an "appointed enterprise" within inter-governmental treaties signed between Ukraine, Bulgaria, and Georgia. ⏳ The case has been under examination for four years. Finally, as a result of the examination of the cassation claim of "AUTOLOGISTIKA", the Cassation Commercial Court of the Supreme Court adopted a Resolution on 13.03.2025, dismissing the claim of "AUTOLOGISTIKA" and leaving the Resolution of the South-Western Appeal Commercial Court under the case No. 916/97/21 in force. 🏛️ ⚖️ The Supreme Court pointed out that courts should take into account the legal nature of the agreement, which should be determined by the content of the parties' relationships, not just the name of the agreement. 📜 🖋️ ANK team drafted the Statement of Defense on behalf of Ukrferry and submitted written statements that were considered by the panel of judges. 📝 As a result, the court dismissed the claim of AUTOLOGISTIKA and remained the Resolution of the Appeal Court in force. 👨⚖️ ANK team on this case was led by the attorneys of the maritime law practice ⚓ Artem Volkov and Kostiantyn Moriakov under the general supervision of Managing Partner, attorney-at-law Oleksandr Kyfak 👨⚖️.

ANK Law Office successfully defended the interests of a leading shipping company in a lengthy litigation. As a result of the litigation lasting over four years, a Ukrainian court ruled in favor of a foreign shipowner, dismissing a claim filed by a seafarer who worked aboard one of the vessels as a crew member. The seafarer demanded compensation of $136 410, alleging unfitness for work at sea. During the proceedings, multiple expert reports were obtained, and several medical examinations were conducted. Combined with other evidence presented in the case, these findings allowed the court to conclude that the shipowner was not at fault for the plaintiff’s unfitness for work at sea. Additionally, the court ordered the seafarer to reimburse the shipowner for legal expenses incurred during the litigation, amounting to over €10 000.
