Aysha Miah has published a new article 'Legal Services Payment Orders – an underutilised tool?' The article explains that "Legal Services Payment Orders were created in 2013 when the Legal Aid, Sentencing and Punishment of Offenders Act 2012 cut large areas of legal aid, meaning far fewer people can access legal advice. In fact only one in four people can now access legal aid. [...] The LSPO was hailed as a new measure to fill the gap that legal aid provision left behind. In reality, very few LSPO’s are sought and even fewer are granted. This article will attempt to explain the criteria the courts will apply in the decision making process and provide practical guidance as to how a case can be issued." Hon. Barry Leon, arbitrator and mediator with 33 Bedford Row and Arbitration Place, recently discussed in an IFC Review article, “Business Disputes Should Be Handled In Business-Like Ways”, why business disputes can become a distraction (or worse) from the main objectives of the business and its #management. “Preventing emerging disputes from expanding, and resolving disputes sooner, offer many benefits in addition to saving legal costs. Businesspeople can get on with their #business, be productive, and keep or get a contingent liability off the business’ books. Management can get on with life without the dispute hanging over them.” Barry concluded “Businesspeople who treat business disputes as business problems to be handled in business-like ways – by being informed about the processes for avoiding and resolving them, and by dealing with them as a reality of their business, without emotion – will wind up with better outcomes, not only for their disputes, but for their businesses as a whole.” #adr #Caribbean #alternativedisputeresolution #commercialdisputes #arbitration #internationalarbitration #disputeavoidance #BVI https://lnkd.in/eRkNYMMK

Dancia Penn, OBE KC, arbitrator and mediator with 33 Bedford Row and Arbitration Place, recently outlined in an IFC Review article, “British Virgin Islands: A Jurisdiction Of Choice For Family Offices”, why the British Virgin Islands (#BVI) is an ideal International Financial Centre (#IFC) in which to establish family offices and why it is seeing increased growth in the establishment of family offices. Among the reasons discussed by Dancia are that BVI is a mature and respected IFC, and meets the essential requirements for the establishment of a family office – a solid and modern legal and legislative framework and environment, a strong regulatory system, access to experienced professional and business services, a good name and reputation, political and economic stability, and an overall positive social and business environment. “Among the services available in BVI for family offices are advice on appropriate ownership structures including trusts, foundations, private trust companies, fund structures, partnerships, philanthropic or charitable structures, and succession planning for future generations through wills and trusts.” She concluded that “All indications are that BVI will increasingly be an IFC of choice for family offices and that there will be a growth in the use of IFCs by #familyoffices.” https://lnkd.in/eMaVFjF8
