There’s a lesson here, that lesson being to always engage a professional, whether that’s at consultancy level or when appointing a tree work contractor. The fine levels at £1,666 with £3000 costs are very light given the estimated £250,000 value of the trees and the ability of the Courts to fine up to £20,000 per tree (or twice the value of the tree, which ever is greater), however a notable sting in the tail for Mr Hussain is the fact that not only does he have to foot the bill for replacement planting (for which the Local Authority can insist on some very hefty and costly trees), but he’s now the proud owner of a criminal record. Claiming ignorance is no defence. What is equally concerning is that the tree work contractor didn’t make the appropriate checks with the Local Planning Authority to determine whether the trees were protected or not. Under UK law, the owner of the tree, the person instructing the work and the person carrying out the work can all be subject to criminal prosecution. In these modern times, making the appropriate checks can be a five minute job. Huyton Trade Park, Wilson Road At ARTAL we are pleased to once again be working with Derwent Estates and The Albert Gubay Charitable Foundation. We are appointed as Employers Agents and Quantity Surveyors for the Construction of 24 units ranging from 1,238 sq ft - 25,000 sq ft and totalling 62,505 sq ft of accommodation at Huyton Trade Park. The scheme hasn't come without challenges and with the great work of Stainforth Construction and the design team we have been able to navigate our way through a number of challenging obstacles and works are progressing well towards completion.
