  • Will I be Banned from acting as a director in the future? 🤔 This is one of the most frequently asked questions we hear, at Beesley Corporate Recovery, by Directors who are facing the difficult decision of closing their business. While there is no straight cut, one size fit's all answer here as each case is individual.. It was reported by the Gazette, that in 2023 there were a total number of 25,158 company insolvencies registered in the UK, and the total number of Director disqualifications in 2023/24 was 1,216. While these statistics may offer a glimmer of hope, the director should not shy away from seeking the advice of an insolvency practitioner sooner rather than later. • “I will present this to parliament, before the summer recess” Last week the UK voted the Labour party into the driving seat, and yesterday Rachel Reeves has announced that she has launched a review into the UK’s spend ahead of the autumn budget, which she plans to present ahead of the summer recess. This announcement may prompt businesses to speed up their decision-making processes regarding MVL applications. Companies that have been contemplating an exit strategy or winding up their operations may find this as an opportune time to move forward. A Members Voluntary Liquidation (MVL) is a solvent liquidation process initiated by a company’s Directors/shareholders to wind up the business in an orderly manner. This can be an attractive option for companies looking to distribute their assets to shareholders, settle any outstanding liabilities and bring the business to a close while complying with legal requirements often in the most tax efficient manner. We often see an increase for the requirements of an MVL when there are changes in policies on the horizon, therefore we recommend that if you have clients who are considering this as an option you are advised to contact us and act soon as possible. • ✨ "Great things in business are never done by one person; They are done by a team of people." ~ Steve Jobs We understand the role team-building activities play in enhancing workplace culture and morale, not to mention productivity; therefore we like to try and arrange a quarterly social. Last Friday afternoon, we collectively took to the Black Cat Club, in Manchester for an afternoon of fun, games and a lot of laughter. Shuffleboard certainly brought out the competitive side in some of us 😅

As the UK gears up for a general election on the 4th July and a potential change in government many businesses may find themselves facing uncertainties and challenges that could influence their decision-making processes. For those that may have been considering retirement or an exit strategy, elections often bring a sense of instability and unpredictability as political parties present differing visions and policies for the future. One pragmatic approach that businesses may consider is the option of a Members Voluntary Liquidation (MVL). An MVL is a solvent liquidation process initiated by a company’s Directors/shareholders to wind up the business in an orderly manner. This can be an attractive option for companies looking to distribute their assets to shareholders, settle any outstanding liabilities and bring the business to a close while complying with legal requirements often in the most tax efficient manner. The prospect of the forthcoming election may prompt businesses to speed up their decision-making processes regarding MVL applications. Companies that have been contemplating an exit strategy or winding up their operations may find the pre-election period as an opportune time to move forward. Here at Beesley’s we often see an increase for the requirement of MVL’s when there are potential political changes on the horizon so we recommend that if you have clients who are considering this as an option you are advised to contact us and act soon as possible. Corporate insolvencies fell month-on-month and year-on-year in May, but numbers were still almost 50% higher than they were pre-pandemic, according to new figures from The Insolvency Service.   Personal insolvencies saw a slight yearly increase, but fell by 15.7% from levels seen before COVID.   Commenting on the statistics, R3 President Tim Cooper of Addleshaw Goddard said that a number of short and long-term issues were continuing to affect businesses, but with the economy growing in the first quarter of this year and predicted to grow again in the next quarter, the tide may be about to turn for the better. Despite this, he noted that the business climate remains challenging and urged anyone facing financial difficulties to seek advice as soon as possible.   You can read the full statement here: https://lnkd.in/eV76rQri   #insolvency #restructuring R3 Association of Business Recovery Professionals
