I have spoken to a few businesses in the last few weeks who have asked for my help to make redundancies. I can certainly support businesses to carry out redundancy processes, however, in a number of these conversations it has come to light that the business was looking to dismiss a particular employee on the grounds of redundancy due to their poor performance or being in some other way unsuitable for the business. New Sexual Harassment legislation needs you to take action. You now have a new mandatory duty to take reasonable steps to prevent sexual harassment in the workplace under the Worker Protection (Amendment of Equality Act 2010) Act 2023. What does this mean? Well, if there is an allegation of sexual harassment made in your business, you’ll have to demonstrate that you proactively took ‘all reasonable steps’ to prevent it from happening. What does taking "all reasonable steps" look like? You should look to: • Conduct risk assessments specific to your workplace. • Implement clear, up to date policies on sexual harassment. • Provide mandatory training to all staff on identifying and preventing harassment. • Encourage a culture of reporting and openness. • Regularly survey staff to assess risks and concerns. What happens if you don’t take action now? In short, if the case goes to an employment tribunal and you are found not to have taken all reasonable steps, the compensation awarded could be increased by up to 25%. You could also find yourself being investigated by the Equality and Human Rights Commission. A further thought to leave you with ..... research shows that a a massive 40% of women experienced sexual harassment in the workplace in 2023. That is a shocking statistic isn't it!
