In recent news, Liverpool-based claims firm McDermott Smith's insolvency has highlighted the challenges and resilience within the litigation funding sector. McDermott Smith entered administration in June with £900,000 owed to funder Fenchurch Legal, yet no assets have been recovered, leaving creditors in limbo. Despite this setback, Louisa Klouda, CEO of Fenchurch Legal, affirms that the sector remains attractive to investors. “Defaults and non-performing firms are inevitable in any sector,” Klouda remarked, pointing to the importance of strong security measures and thorough due diligence to protect investments and reduce potential credit losses. This situation also highlights the role of After The Event (ATE) insurance in managing risk. Have you seen the latest Housing Ombudsman report on damp and mould cases? It is sobering reading. Twenty major housing providers (including some of the UK's largest) are highlighted for severe maladministration in handling these issues. What really stuck out was the compensation of just £150 offered to a family who couldn't use their bedrooms for five years due to extensive mould. With Awaab's Law in motion, it's clear the sector needs to do better. The report shows repeated patterns of delayed inspections and repairs, with residents experiencing significant health issues as a result.
