Schedule 10A FSMA: No Reliance without Knowledge and No Dishonest Delay without Subsequent Publication The High Court (Leech J sitting as a Judge of the Financial List (ChD)) has summarily dismissed claims for damages brought pursuant to section 90A and Schedule 10A of the Financial Services and Markets Act 2000 (“FSMA”) by 241 Claimants against Barclays Bank plc in respect of various alleged misstatements or omissions in certain published information. James Flynn KC It is with profound sadness that Brick Court announces that our much respected colleague, James Flynn KC, died on 10 October 2024 after a short illness. James was a leading competition law litigator at the London Bar and a highly valued member of chambers. He will be much missed by all at Brick Court and beyond. Court of Appeal refuses Meta permission to appeal certification of data abuse claim On 7 October 2024, the Court of Appeal declined to grant Meta permission to appeal the CAT’s certification of collective proceedings against it. Those proceedings, brought by Dr Liza Lovdahl Gormsen on behalf of Facebook users, allege that Meta abused a dominant position in the market for provision of social network services, by charging an unfair price and/or imposing an unfair trading condition in the form of requiring users to grant Meta access to their Off-Facebook Data (i.e. data concerning users that is gathered on third party websites and applications and other non-Facebook Meta services, e.g. Instagram).
