Sarah Sackman, Minister of State for Justice, has today laid before Parliament the Whiplash Injury (Amendment) Regulations 2025.   The Regulations are likely to be approved by both Houses, meaning that the below Tariff will apply to injuries sustained on after 31 May 2025. As the trigger for the new tariff is the accident date, it will take some months for the new figures to filter in to awards. Insurers will need to consider reviewing reserves.    While the new figures increase the risk of claims moving into the fast-track, the latest OICP figures show that less than 4% of injuries have a duration above 12 months (£2,335), meaning that the number of cases likely to become cost bearing will remain small.   If you would like to discuss the review, or any aspect of the injury market, please feel free to contact Alan Hayes or Paul Challoner at Carpenters.

It is today being reported that the Government intends to review the Civil Liability Act, scheduled for the second half of this year.  The nature and purpose of the review may become clearer following publication of the MOJ’s post-implementation report, which is expected in the coming weeks, but there are a number of points that are likely to be considered:   - The OIC Portal has cost of £31 million more than expected, which has been funded by motor policyholders. - Despite the intention of the whiplash reforms to reduce motor insurance premiums, there has been no significant evidence of such reductions. - The OIC Portal process has been criticised for failing to deliver justice for innocent accident victims, deterring consumers, delaying claims, and burdening the courts. - The number of litigants-in-person is far lower than expected.   Carpenters welcome the Government's review and are eager to support this initiative. We will provide more information as it becomes available.
