🚀 Appeal Success: 62 Homes Approved in Edith Weston, Rutland! 🏡 We’re delighted to share that our appeal for 62 dwellings in Edith Weston has been allowed! This follows a previous dismissal that was quashed at the High Court. With Rutland facing an acute housing shortfall, the decision recognises the urgent need for new homes, with the Council unable to demonstrate a five-year land supply. This scheme will provide 40% affordable housing alongside self-build plots, ensuring a diverse mix of housing options. The Inspector found that the development would form a logical extension to the village, with structural landscaping helping to integrate it over time. A well-argued case and a great result for housing delivery in Rutland. 🎉 Huge thanks to the many excellent people involved in this success, including: Jonathan W. of Francis Taylor Building Andrew Swaffer of Sharpe Pritchard Solicitors & Parliamentary Agents Jon Byrd of Allied Ecology Ltd James Morton and the team at Aspect Landscape Planning Ltd Andrew Moseley, Aaron Yesudian and the team at Andrew Moseley Associates Transport and Development Planning Sam Falco of Sam Falco Heritage Consulting Russell Trimble of WITHAM ARCHAEOLOGY LTD ...and our very own Matthew Taylor #Planning #AppealSuccess #HousingSupply #ClassQ #AffordableHousing #Development #Rutland

🏡 Planning Success: Stable Conversion Near Oakham! 🏡 Another great result for our client, securing planning permission to convert a stable building into a new home in rural Rutland. This was a challenging case, but our strategy successfully navigated key hurdles: ✔️ Policy Obstacle Overcome – We demonstrated that there were no strong economic reasons to prioritise commercial uses over residential, as required by policy. ✔️ Fallback Position – A historic unimplemented permission to extend the stables provided a clear route to deliver a dwelling beyond the existing built envelope. ✔️ Amenity Issues Resolved – A unilateral undertaking ensured the property remains tied to a nearby builder’s yard, addressing potential amenity concerns. A well-planned approach leading to a positive outcome. Looking forward to assisting with the next steps! 🚀 #PlanningPermission #StablesConversion #Rutland #PlanningSuccess

🏡 Planning Permission Secured for Barn Conversion in Burythorpe, North Yorkshire! 🏡 We're pleased to share that full planning permission has been granted for the conversion and partial rebuild of a traditional stone-built barn in Burythorpe, North Yorkshire. This approval paves the way for a carefully considered four-bedroom dwelling, sensitively designed to enhance the character of the village edge. 🔹 Key Highlights: ✅ Retention and restoration of the historic barn, with sympathetic alterations ✅ Demolition of unsightly modern structures, improving visual amenity ✅ New single-storey link extension, seamlessly connecting the rebuilt barn to an existing building ✅ Thoughtful landscaping and associated parking This project forms part of a wider cohesive farmyard redevelopment strategy, complementing a recently secured Class Q approval for four additional dwellings on the adjacent site. It's a great example of how well-considered rural development can preserve heritage, improve aesthetics, and deliver high-quality homes. Looking forward to seeing this transformation take shape! 🏗️✨ #BarnConversion #PlanningPermission #RuralDevelopment #NorthYorkshire

🏡 Planning Milestone Achieved in Saltby! We are pleased to announce that Class Q has successfully secured planning permission for a 3-bedroom home in the village of Saltby, near Melton Mowbray. This development represents a significant step forward for our client, a young family looking to build their future close to relatives. The journey to approval wasn't straightforward. Following a previous refusal in 2022 due to concerns about local need and the proposal's fit with the village character, we were engaged in an attempt to turn the tide. 🔑 Our Strategic Approach: Tailored Advice: We focused on the critical issue of demonstrating local need. Robust Evidence: A commissioned Housing Needs Assessment substantiated the demand for two dwellings in the parish, including this 3-bedroom home. Design Alignment: We revamped the design to ensure harmony with the village’s aesthetic. Persistence and detailed reference to similar successful appeal decisions (including our own Class Q) ultimately convinced the Council. Their acceptance of the Housing Needs Assessment led to the green light for this development. This project underscores the importance of expert guidance in achieving planning success. We eagerly anticipate bringing this essential home to life for our clients. #PlanningSuccess #ClassQ #HousingNeeds #Saltby #PlanningPermission

🌟 Great News from Tewkesbury! 🌟 We’ve just crossed the finish line with Tewkesbury on a project that’s been two years and four case officers in the making. We're excited to share that we’ve received the green light to transform a disused farmyard into four beautiful new homes! This project is particularly special as it not only breathes new life into an underused space but also thoughtfully enhances the area next to a grade II listed building. We’ve even woven the site's old machinery store into one of the dwellings, preserving a slice of its history. Here’s to breaking ground and crafting spaces that our future residents will be proud to call home. #TewkesburyDevelopment #HeritageHomes #NewBeginnings

FULL AWARD OF COSTS - Council accuses appellant of 'point scoring' 🔍 Key Points from the Decision: Handling of the applications was "indicative of the Council’s misunderstanding of Class Q and the extent of the development it permits". The Council failed to provide objective analysis or evidence to support their refusal, relying on vague and generalised assertions. Inconsistent decision-making was highlighted and the "failure of the Council to provide adequate reasons for taking a decision contrary to 22/5037M amounts to unreasonable behaviour." "[10] The Council suggest the applicant submitted three appeals for the same site ‘purely for point scoring reasons’. This is a wholly unreasonable and unwarranted remark to make by the Council, not only because the three appeal developments are all different, but the applicant has every right to exercise their right to appeal the Council’s decisions. Indeed, the fact that all three appeals have now been allowed validates their decision to do so. [11] The lack of an application for an award of costs being made in relation to a previous appeal, whether by the appellant or the Inspector, does not mean unreasonable behaviour did not occur. It simply means no argument was made that it had. [12] Overall, the failure of the Council to make an objective analysis of the evidence before them and their lack of consistent decision-making amounts to unreasonable behaviour. In such circumstances, it is evident the appeals in this case could have been avoided if the Council’s unreasonable behaviour had not taken place. The applicant, therefore, suffered wasted expense in pursuing the appeals and a full award of costs is justified." #Planning #PermittedDevelopment #ClassQ #UrbanPlanning #TownPlanning #PlanningAppeal #AppealDecision #CostsDecision #Development #PlanningPermission #DevelopmentControl #PlanningPolicy #LandDevelopment #PlanningInspectorate #PlanningLaw
