FULL AWARD OF COSTS - Council accuses appellant of 'point scoring' 🔍 Key Points from the Decision: Handling of the applications was "indicative of the Council’s misunderstanding of Class Q and the extent of the development it permits". The Council failed to provide objective analysis or evidence to support their refusal, relying on vague and generalised assertions. Inconsistent decision-making was highlighted and the "failure of the Council to provide adequate reasons for taking a decision contrary to 22/5037M amounts to unreasonable behaviour." "[10] The Council suggest the applicant submitted three appeals for the same site ‘purely for point scoring reasons’. This is a wholly unreasonable and unwarranted remark to make by the Council, not only because the three appeal developments are all different, but the applicant has every right to exercise their right to appeal the Council’s decisions. Indeed, the fact that all three appeals have now been allowed validates their decision to do so. [11] The lack of an application for an award of costs being made in relation to a previous appeal, whether by the appellant or the Inspector, does not mean unreasonable behaviour did not occur. It simply means no argument was made that it had. [12] Overall, the failure of the Council to make an objective analysis of the evidence before them and their lack of consistent decision-making amounts to unreasonable behaviour. In such circumstances, it is evident the appeals in this case could have been avoided if the Council’s unreasonable behaviour had not taken place. 🏡 Exciting Development News in Historic Barrow, Oakham! 🏡 We're delighted to announce the unanimous approval by Rutland County Council for a new, bespoke 4000 sq. ft. dwelling in the picturesque village of Barrow. This approval marks a significant milestone following our initial consent under Class Q in November 2023, which allowed for the conversion of an existing barn into a dwelling. Building on that success, we proposed the demolition of the old barn to make way for a new-build that is more in tune with the local architecture. Thanks to a collaborative and iterative design process with the RCC planning and design officers, we have crafted a proposal that singnificantly enhances the site's context when compared with the original conversion. A special shoutout to Alice Maylor for her exceptional designs, which have been instrumental in achieving a result that far exceeds the original scheme in both functionality and aesthetic. 🎉 APPEAL ALLOWED FOR UP TO 30 HOUSES IN BRAUNSTON-IN-RUTLAND! 🎉 We are delighted to announce that our appeal was allowed this morning granting permission for the development of up to 30 dwellings at Brooke Road, Braunston-in-Rutland. The Inspector concurred with our arguments that the locational development plan policies did not recognise the intrinsic character and beauty of the countryside and were based on outdated housing requirements. He also agreed that, as there had been a reliance on unallocated countryside sites to meet the housing requirement, were housing only approved in line with the constraints set out by policies CS4, CS9 and SP6, the Council would have been (and will continue to be) unable to deliver its required housing numbers. Polices CS4, CS9 and SP6 therefore run contrary to the Framework’s objective at paragraph 60 of significantly boosting the supply of homes and are out of date. Thanks for the useful update, Ian Walmsley. For clarification, Article 10 [1] provides transitional arrangements so that any development that was permitted under Class Q immediately before the changes come into force but is no longer permitted as a result will continue to be permitted for a further 12 months. So, the date for submission if you require a larger dwelling is the end of 20th May 2025. This will allow time for any applications for prior approval prepared under the existing right’s conditions and limitations to be submitted and decided under those conditions and limitations. This includes for example the delivery of larger and smaller homes. Those homes must be delivered within three years of the prior approval date. However, it should be noted that any additional flexibilities being introduced – such as the ability to erect an extension as part of the change of use – will not be applicable to any scheme that delivers dwellinghouses with a floorspace over 150 square metres for this transitional period. ‼️Big changes to Class Q and Class R for agricultural buildings incoming….. ‼️ You can now create up to 10 dwellings, although each home is now limited to 150 sq m. If you need a home larger than 150 sq m, you must apply before 21st May. You can also have rear extensions of up to 4m on hard standing that already exists. Some barns that previously did not qualify, now will do so. Class R has been extended to allow for some general industrial and outdoor sports and recreation in barns. All the details can be found at the link in the comments with some changes to new barns and extensions of existing barns for farmers.
