  • 📢 Court of Appeal rejects challenge in age assessment appeal   Today (18 Feb 2025), the Court of Appeal handed down judgment in R (AI) v West Berkshire Council [2025] EWCA Civ 136, rejecting the appellant’s reasoning challenge in an age assessment dispute. The case involved a refugee from Sudan whose age was assessed by West Berkshire Council in December 2021. The key issue on appeal was whether the Upper Tribunal (UT) Judge provided adequate reasoning for assigning the appellant a date of birth of 20 April 1998. Lord Justice Singh ruled that the UT’s reasoning was sufficiently adequate, emphasising that: ✅ The Tribunal’s reasoning must be read in full context. ✅ There was no duty on the Tribunal to find an alternative date of birth. ✅ The appeal solely on the adequacy of reasoning must fail. Over the course of the next seven months, we will convene a series of webinars drawing out lessons from climate litigation in various countries across the globe. Each session will involve speakers from the jurisdiction introducing the key climate cases, sharing their litigation experiences and drawing out the litigation lessons that can be learned.   • A local authority has been ordered to pay costs to a private hire operator after it offered no evidence against him in an "improper" prosecution. The case involved Lucky Seven Taxis, a Midlands-based operator with licences across multiple councils, who found themselves wrongly prosecuted by the council for operating in its area without holding a valid operator's licence. The prosecution, which lasted over two years, ended with the council conceding that it couldn't prove its case – and a rare order for costs being issued against the council for conducting the prosecution improperly. Key takeaways: “Operating” has a specific legal meaning and the offence of operating in a controlled district without an operator’s licence requires that the arrangements for accepting bookings and dispatching vehicles physically took place within that district.   • 🚨 Major nature charity intervenes in Supreme Court case on nutrient neutrality 🚨   Today, the Supreme Court begins hearing the appeal in C.G. Fry & Son Ltd v Secretary of State for Levelling Up, Housing and Communities & Somerset Council. At stake? The crucial question of when nutrient neutrality rules should apply to protect internationally important nature sites from harmful pollution.   Wildlife and Countryside Link (Link) is intervening in writing, represented by Estelle Dehon KC, Nina Pindham, and Hannah Taylor. Link is the largest coalition of environment and wildlife organisations in England, bringing together 86 organisations working to protect nature.   ⚖️ The case concerns the Somerset Levels & Moors, a globally important wetland under the Ramsar Convention. The Court will decide how the Habitats Regulations 2017 apply in multi-stage consenting and whether protection of a Ramsar site from the harmful impact of pollution is a planning purpose relevant to the discharge of conditions where that is the implementing decision for a multi-stage consent. 🔎 Link argues that nutrient neutrality must be applied at all relevant planning stages—not just the earliest.   • Kuljit Bhogal KC, leading counsel for Manchester City Council, has successfully secured a possession order against individuals residing in a tent encampment in St Peter’s Square, marking a crucial legal victory for the local authority. The encampment faced legal challenge from the Greater Manchester Law Centre. However, the court ruled in favour of the council on Tuesday, allowing it to reclaim the public space. The council argued that St Peter’s Square was not a safe or suitable environment for those experiencing homelessness and that alternative accommodation options were available. Representing the council, Kuljit Bhogal KC robustly countered allegations that the statutory duty to house vulnerable individuals had been bypassed. She highlighted that support, including accommodation through temporary housing or private landlords, had been offered and that organisations such as Mustard Tree provided additional services, including interpreters and warm spaces for those in need. Judge Nigel Bird determined that the encampment’s presence in a key public space was unlawful and ordered its removal. He expressed confidence that those affected could use the statutory framework of the Housing Act 1996 and would be supported appropriately.
