The FCA’s Consumer Duty heralds a significant transformative shift across the financial services sector. Embedded within this duty, is the obligation for firms to “act to deliver good outcomes” for their retail customers. This includes being cognisant of market inefficiencies (such as behavioural biases and information asymmetries) and acting to ensure that they do not lead to consumer exploitation. With the cost of living on the rise, consumers are pressured to make important financial decisions quickly, in an increasingly complex environment. This duty requires businesses to conduct themselves ethically and ensure that consumers are well-informed when making such financial decisions.
