If any of your future trainees failed the SQE1 last week, here’s some reasons to support them: ➡️ The exam is HARD. 360MCQs across 10 hours over 2 days. This is not the LPC. The SRA allows three attempts for a reason. ➡️ There are still a number of glitches with various aspects of the process meaning that many students aren’t being taught the proper content for the exams, provided the correct conditions for taking the exams or afforded equal opportunity of passing. It’s still a new system, give the students the benefit of the doubt. ➡️ The SQE was designed to be taken instead of a training contract, not as well as one. If you are asking candidates to do both, you are testing their competence twice. You can afford to give them some leeway. ➡️ An MCQ exam ≠ life in legal practice. You have chosen your candidates based on their competence over a range of factors. Contextualise the importance of passing this exam first time accordingly. ➡️ You are decent, empathetic human beings and you want the same for your next generation of workforce. Humility breeds loyalty and the more you support your candidates, the more they will support you back. I could continue, but I think that’s more than enough to go on.

Build a team of individuals that support each other and are confident enough in their abilities that they don’t need you when you’re away. Published this morning is a Law Society Gazette piece in which I argue the Legal Services Board (LSB) plays such a significant causation part in the regulatory challenge for law firms, solicitors and the other legal professions that it is time to scrap it. The public deserve better than the underwhelming LSB. The public and the profession deserve better than the LSB can offer in terms of oversight into the frontline regulators. Zero benefit, increasing costs and nothing meaningful to meet the statutory requirements of Section 1 (1) of the Legal Services Act 2007 states: "In this Act a reference to “the regulatory objectives” is a reference to the objectives of— (a) protecting and promoting the public interest; …. (c) improving access to justice; (d) protecting and promoting the interests of consumers; …. (h) promoting and maintaining adherence to the professional principles;" My open challenge to the Justice Committee of the House of Commons is to invite the regulators and the professions representative bodies to address the LSB's failings. The LSB has never put forward meaningful and impactful evidence of the LSB achieving something - anything - for the public interest or the interests of the professions. The LSB publishes reports in gobbledygook, the consistent theme? The reports are always vacuous. I am a long term critic of the LSB, as wasting the professions money for no public interest has always seen to me to be a folly. The LSB is though getting worse, spending more and is less effective now than ever before because it failed to see the risks of the changes it was promoting and encouraging over the last decade so it is in full deflection mode and passing the buck to frontline regulators. An approach which rather begs the question: Where is the value to the public interest or professions in your work?
