In the recent case of MacLennan v British Psychological Society, 2024 the Claimant was a charity trustee. The Claimant’s position as a trustee and President-Elect was terminated following a falling out with the senior management team of the Respondent. The Claimant brought claims for whistleblowing on the basis of suffering less favourable treatment. The case is of significance to the non-profit sector. Although a trustee may not be an employee, they may still have rights before an Employment Tribunal as a whistleblower as a worker. The Government has now announced the new National Minimum Wage rates, set to take effect from 1 April 2025. The Government has accepted the Low Pay Commission’s recommendations in full (which took account of the ongoing cost of living crisis and inflation trends projected up to March 2026), and has taken steps to reduce the pay gap between those aged 18-20 and those aged 21 and over. After someone dies, others must take responsibility for dealing with and distributing the estate of the deceased. If the deceased has a Will, this person will be referred to as an Executor. It is an Executor’s duty to carry out the wishes of the deceased and distribute their assets according to the terms of the Will. Where more than one Executor has been appointed, they must act jointly. It is usually the case that the distribution of assets runs smoothly with both Executors working together efficiently, however, emotions and tensions can sometimes get in the way and create conflict. In the Carnival Plc v Hunter case, an employee on maternity leave was made redundant after her role was eliminated due to a company restructure. The claimant later filed claims of unfair dismissal and maternity discrimination, arguing that she wasn’t offered alternative roles, even though suitable vacancies existed. The Employment Tribunal found this a breach of Regulation 10, which requires that employers prioritise offering any available roles to employees on maternity leave before considering them for redundancy.
