  • World Menopause Day – 18 October 2024 Menopause is a natural phase in a woman’s life, yet it remains shrouded in stigma and misunderstanding. The menopause has a ripple effect impacting on colleagues, partners, and on business productivity. World Menopause Day helps highlight the importance of supporting women through this transition, especially in the workplace. Failing to support employees can cause extended sickness absences and impact on employee retention. Shocking statistics Statistics provided by “Women of a Certain Stage” reveal: - 30% of marriages end in divorce during the menopause transition, largely due to a lack of understanding and communication - More than 75% of women experience symptoms that disrupt daily life , yet only 10% feel comfortable discussing menopause openly - 61% of women say menopause negatively impacts their mental health , affecting not only them but those closest to them Over 10% of women who have worked during the menopause have left work due to their symptoms, a survey has found (by the Fawcett Society). Understanding and empathy from colleagues and management are crucial. Menopause can, but not always, bring a host of challenging symptoms, such as memory lapses, mood swings and hot flushes. A supportive work environment where colleagues are considerate of those challenges, can alleviate much of the stress and discomfort for individuals experiencing menopause. New legislation The Employment Rights Bill set out key measures which could potentially be introduced in 2025/2026. One of these reforms will be for employers with more than 250 employees to set out steps they are taking to support employees going through the menopause. There are benefits for smaller businesses in adopting this approach too. Consider preparing a menopause action plan now ahead of it becoming a legal requirement.     A bit of an anti-climax? After much hype about the Employment Rights Bill being presented to parliament on 10 October, there was little discussion on this topic in the House of Commons today. In fact, there were more references to the Leader of the House of Commons’ special birthday than the contents of the Bill. The Rt Hon. Lucy Powell MP announced that the Bill would give people “dignity and security at work” and create a “high wage, high skilled economy”, referencing the ending of fire and rehire policies and day one rights to parental and bereavement leave and protection from unfair dismissal. The other key information we gleaned was that the Bill will have its second reading in the House of Commons on 21 October. This is the second of twelve stages of the Bill’s passage through parliament. So don’t panic, there is time for consultation and redrafting details before the proposed legislation gets anywhere near landing on desks of HR teams and business owners. By lunchtime we decided were not going to get any more out of listening to the parliamentary discussion and headed out for a sunny walk instead, discussing everything from new clients to holidays and our favourite escape routes when we need to get away from it all. After returning to tea and cake, we downloaded the now published draft Bill (158 pages) and the 104-page accompanying notes. Key changes proposed include the following areas: ⌚Zero hours work ⚖️Flexible working 🤮Statutory sick pay 💰Tips and gratuities 👶Parental and bereavement leave ❌Protection from harassment 🔥Protection from dismissal (including removal of qualifying period for unfair dismissal and changes relating to dismissal during pregnancy and after a period of family leave) plus for failing to agree to a variation of contract (fire and rehire) 😒Redundancy (including a section on ships’ crews) 🙂Public sector outsourcing (protection of workers) 💵Pay and conditions relating to school support staff and adult social care sectors 🦾Trade union access and recognition 🤵Industrial action, including a repeal of minimum service levels 🤝Enforcement and advisory bodies In addition, reference to removing “discriminatory age bands” in minimum wage levels is in the accompanying notes to the Bill. Eagle-eyed observers may note some previously mentioned proposals are missing and have been pushed back to a second phase, including: 📴 Right to switch off 👷 Creation of a single status of worker The key message is don't panic! Some changes may not come into force until 2025/26 and some may be watered down. The key will be involving relevant bodies and industry at committee stages to ensure the details work in practice. It will be important to ensure that there are no unintended consequences: the principle of making work pay may be admirable but would proposals make employers more wary of taking chances on hiring individuals with gaps in work history, or price young people without experience out of the labour market?

    Phew, September was busy and there's no let up in October with the biggest shake up in employment law coming our way! The start of a new month and this morning got off to an early start with a business breakfast event at Hartham Park hosted with Corsham Town Council. A beautiful venue recently refurbished, a warm welcome and lots of discussions over coffee with local entrepreneurs. Good to hear how our new MP for Chippenham sarah Gibson is engaging with the business community. It was also good to have the opportunity to speak briefly about how the team at KR HR & Training Consultancy Ltd are getting ready to support businesses with imminent legislation changes.     Today I was up bright and early to give a talk to Wiltshire business owners about the impending changes in employment law proposed by the new government. Labour’s “plan to make work pay” will likely bring seismic changes to the world of employing and managing people. I highlighted key potential areas for change including: * Unfair dismissal a day one right * Statutory sick pay * Further revisions to flexible working * Minimum wage * Zero hours contracts * Right to switch off (sounds appealing sometimes 😉 but what are the practical implications) * Family related leave Whilst we don’t have all the details yet, I aimed to demystify the headlines, take the fear out of some of the proposals, and highlight how employers can protect themselves through using consistent and effective HR practices from a well-managed probation and induction process to sickness absence management such as return to work discussions. Thank you to Business Growth Group members for being a great audience with many interesting and perceptive questions. Taking into account the needs of the business community will be essential in drafting the details of these changes. We will provide further updates in due course once draft legislation is laid before parliament by mid-October.
