ARTICLE | The Court of Appeal Hands Down Judgment in Johnson v FirstRand Bank Limited (London Branch) t/a Motonovo Finance Matthew Gillett's recent article reports on a judgment handed down this morning by the Court of Appeal in three related appeals (Johnson v FirstRand, Wrench v FirstRand, and Hopcraft v Close Brothers), whereby the court ruled in favor of the Claimants, who are entitled to compensation equivalent to secret commissions that their lenders paid to car dealerships. This decision is expected to impact many similar cases across the country, as there are numerous pending 'motor finance commission' cases awaiting resolution, many of which had been on hold until this judgment was delivered. Members of Lamb Chambers, in association with Flint Bishop, recently had the pleasure of delivering “mock trial” training sessions to Haven Insurance Company Limited/Acorn Insurance and Financial Services Limited in Sevenoaks and Liverpool. The mock trial was a claim for credit hire charges and vehicle damage brought by a licenced taxi driver following an accident which was not his fault. The sessions provided valuable insight into the crucial role of the evidence presented at trial, and how subtle differences can give rise to different outcomes when the Court is considering the guidance in Hussain v EUI, underlining the importance of case preparation. Richard Menzies took the role of the judge, and the advocates were Joanna Kerr, Morgan John, Christopher Green and Emmanuel Michelakakis-Howe. Lamb Chambers are particularly grateful to Karima Amlani for organising the sessions and ensuring that everything went smoothly. Lamb Chambers (Chambers of Richard Power) is pleased to announce the extension of the application deadline for two probationary tenancies, commencing on 6 January 2025. The new closing date for applications is Friday 4 October 2024. The successful candidates will join our dynamic team of barristers and gain invaluable experience in our core practice areas: Commercial, Personal Injury, and Property. A demonstrated interest in or commitment to building a career in at least one of these areas is essential. Probationary Tenants will undertake two seats, each lasting three months, under different supervisors and in distinct practice areas. They will have the opportunity to regularly attend court and handle cases on their own. Tenancy will typically be considered towards the end of the probationary period. Guaranteed earnings for any new Probationary Tenant are set at £30,000 for the 6-month term. Candidates should demonstrate outstanding academic credentials, strong interpersonal skills, excellent references, and a genuine ambition to excel at the Bar.
