TikTok may be friends with Universal Music Group again after their fallout earlier this year, but now it is at loggerheads with another important music-licensing partner: Merlin. That's the licensing agency that represents independent labels, striking deals on their collective behalf with streaming services and social-media firms. TikTok included. Well, until now. Both sides have confirmed today that TikTok wants to sign direct deals with Merlin's members instead, cutting Merlin out of the licensing picture. "This past Wednesday, with no warning, TikTok walked away before negotiations even began. They informed us that (1) they do not want to renew our deal, which expires on October 31st, and (2) they intend to license some of our members directly," explained Merlin's letter to members. What does TikTok have to say about this? "TikTok would like to offer all of the world's music to our users. We are committed to working with the independent sector as well as the major labels and publishers," said its statement. "We know that our community of over a billion music fans value the diversity and richness that independent music brings to our platform. We are committed to entering into direct deals with Merlin members in order to keep their music on TikTok." Some music videos have been removed from YouTube after the company reached a licensing impasse with a collecting society. No, veteran readers, you haven't been transported back to 2009 and the days of GEMA / PRS disputes in your sleep... This is 2024 and US-based Sesac is the collecting society. Videos from artists including Adele, Nirvana and Kendrick Lamar are unplayable in the US as things stand. "We have held good faith negotiations with Sesac to renew our existing deal. Unfortunately, despite our best efforts, we were unable to reach an equitable agreement before its expiration," is YouTube's statement on the situation. We’ve made the point before that the music industry wants AI companies to sign licensing deals if they want to train their models on rightsholders’ music – but the structure of those deals remains to be thrashed out. Now German collecting society GEMA has presented some of its ideas on the songwriters side. “This approach is based on the use of music to train AI models but goes beyond the primary use. It also means authors must be adequately involved in the subsequent generation of AI content based on their creative work,” is how GEMA described it in its announcement this morning. “Pure remuneration through a buyout, i.e. a one-off lump sum payment for training data, is not nearly sufficient to compensate authors in view of the revenues that can be generated.” Read The Full Story Here: https://lnkd.in/dVH_pKPS #musically #musicnews #readmore

We’ve been following the debate in Canada around plans for a 5% levy on the local revenues of global music and video streaming services. The levy would fund locally-made TV shows, films, music and culture, but has been opposed by streaming services and Canadian labels body Music Canada. Now it has signed a joint letter with the DSPs’ representative body DiMA following a recent round of meetings to discuss the plans. Who doesn’t like to start their Friday by considering the ins and outs of Belgium’s implementation of European copyright legislation, eh? We are here to serve, as ever. This is a complicated but important story, in all seriousness. It relates to the EU’s 2019 copyright directive, which was broadly welcomed by the music industry. However, each of the EU’s member states then got to implement the legislation, including their own changes. Belgium made a big one. It introduced a “non-waiverable remuneration right” to be paid by streaming services and distributed by collecting societies to artists. Umbrella featured-artists body IAO welcomed it at the time, pointing to existing examples of such a right in Spain, Hungary and Slovakia. However, it was not in the original copyright directive, and labels have been fighting the Belgian implementation ever since, lodging a constitutional challenge against it. Now there’s some news. The case has been referred by the Belgian constitutional court to the European Court of Justice. Indie labels collective Impala and Belgian body BIMA both announced the news with strong approval. Believe has owned a 60% stake in Turkish independent label Doğan Music Company (DMC) since 2020, but last month it announced plans to buy the remaining 40% of the company to take full control. That deal would be subject to approval by the relevant competition regulator however. Said approval has now been granted, and Believe has completed the acquisition.
