Thank you to all the speakers and participants who joined us in Brussels on Tuesday for our competition conference, co-organised by Oxera, Paul, Weiss, Rifkind, Wharton & Garrison LLP and MLex. We had a full agenda and some truly insightful discussions across a wide range of hot topics in competition policy, including: • The future of merger control in the EU and UK: growing emphasis on economic growth, revised horizontal and non-horizontal merger guidelines, and early signs of a more open stance on efficiency claims, including innovation and investment defences. • Recent developments at National Competition Authorities, including determination by some to obtain call-in powers to review potential killer acquisitions and serial acquisitions, as well as calls to maintain the independence of competition agencies at the same time as framing competition policy as one tool of a broader economic policy. • The role of economics in competition policy: the new Chief Economist of DG Competition highlighted the importance of a dynamic view of consumer welfare, and the need to consider how competition policy should take into account market failures, and properly interact with regulation, industrial policy, and innovation policy. • The future of Article 102 enforcement: including reflections on the draft guidelines’ proposed two-step test, use of presumptions, the concept of “competition on the merits,” and how guidance can support a pro-growth, dynamic economy. • Latest trends in US antitrust, both institutional and substantive. The Autorità Garante della Concorrenza e del Mercato AGCM conditionally cleared, in Phase II, the acquisition of Edison Stoccaggio by Snam S.p.A. (Case C12686). The AGCM concluded that the remedies proposed by Snam concerning the gas storage modulation service adequately overcome the competitive implications of the merger. Oxera assisted Snam on this transaction, working alongside BonelliErede and Chiomenti. Our economic assessment focused on the role of sector regulation. The Oxera team on this transaction was led by Roberto Alimonti and comprised also Alfredo Macchiati, Rebecca Vitelli, Viola Conte, and Andrea Bianchi.
