The main topic was the #UPC and we heard from litigators, judges and users of this new and important EU #patent court system. Asides from the IT issues, it seems that experiences have been very positive in the early days of the new system. 💡A key takeaway for me was that the rapid timescales give some natural advantage to the first mover in any of the proceedings. It was also a joy to catch up with many old friends and meet some interesting new people - too many to tag 😆 I’m very pleased that congress ventured outside of London and it was a pleasure to have it hosted here in 🏴, in the fine setting of #Edinburgh ▪ ▪ ▪ #whereinnovationthrives #intellectualproperty #ip #CIPAConference

The USPTO has announced it is terminating a pilot program that was designed to make #patent prosecution more efficient. Peter McBride has shared some thoughts 👇
The USPTO has announced it is going to terminate the AFCP, or "After Final Consideration Pilot program 2.0" for #US #patents This "pilot" has been running in various forms for over 10 years, and has given some flexibility to applicants in the latter stages of patent prosecution. Apparently, it involves some overheads from the USPTO's side: they proposed a $500 fee for the procedure which received negative feedback from users, so the USPTO said "Fine!" and then shut the whole thing down in a huff. 😤 🤚But wait, what is (or was) it anyway?!?!? Basically the USPTO is keen to avoid endless rounds of correspondence and prosecute patents efficiently. So examination is designed to be concluded in a maximum of two rounds; a first report is "non-final" and then a subsequent report is "final". The options for responding to a "final" report are more restricted; but basically if any new thinking is required then the examiner will be looking for more fees - either by a Request for Continued Examination (RCE) or by filing an Appeal. The idea of the AFCP was to give a bit more "wiggle room" for the Examiner to consider some new ideas even after a final action has been issued, so that an applicant can avoid paying an RCE or Appeal fee. So in principle it's disappointing to see this option be retired. It puts a bit of an increased burden on applicants to bring cases to acceptance more quickly. But in any case, in my experience the AFCP has delivered less than advertised - it's just anecdotal but I have felt that the amount of "extra" examination an examiner is willing to do under the program is quite limited, and also relies on their subjective judgement. That's one reason why we favour early phone interviews with Examiners to build consensus and bring cases to allowance efficiently. The main frustration I have in patent prosecution in the US is with general quality of objections - we spend a lot of time explaining the meanings of words or arguing against prior art that is clearly irrelevant; improvements in basic quality would help greatly with bringing cases to swifter conclusions. In any case, to make a tenuous link with the topic I have included a random #sunset picture (seeing as the AFCP is being "sunset") - this was taken a while back in the #Cowal peninsula on the west coast of #Scotland. It's an area overlooked by most "must see" guides but it is close to #Glasgow and has lots of great scenery and activities to enjoy!
