I had the pleasure of joining a panel of BEPS Pillar 2 industry and professional experts at Informa Connect - TP Minds Series today in Sydney today along with Janice Lo Petra Mumford Catherine Dean Denise Brotherton. In the session we shared a range of very practical experiences and insights on managing organisational responses to the Pillar 2 regime both in Australia and globally including lessons learnt from global tax transparency/ public CbCR implementation that can be used for P2 implementation. A key takeaway was emphasising the importance of being proactive in responding to the measures, not underestimating the time required to implement systems and processes, managing your stakeholders to facilitate compliance with the measures along with ensuring open communication between head office and subsidiaries. 🌏🎤⚠️ TP Minds - The Ongoing Debates TP Minds has had some excellent panels and presentations over the last couple of days in Sydney. There are quite a few open questions in the TP and tax controversy space: 🏛️ Will the High Court ever get a perfect TP financing case to take on? 🔜 Will the ATO’s PCG on withholding tax for software arrangements drop in December or January? Even if Pepsi isn’t finalised by then? 🧐 Will the ATO revise its draft software ruling given the Pepsi FCAFC decision - particularly the bit about the consideration analysis? 📅 When will we see draft law from Treasury on the Part IVA extensions to cover withholding tax rate reductions and incorporate foreign tax into the purpose analysis? They were announced in the May 2023 Budget. It was nice to finally present on the Pepsi decision with an IP valuer (John-Henry Eversgerd), and also to do my first impromptu panel appearance - a financing panel with Bill Yohana, Prashant Bohra and Benjamin Egan to sub in for James Strong. At the TP Minds conference this week in Sydney (Informa Connect - TP Minds Series), JWS Partner Annemarie Wilmore and Special Counsel Don Spirason presented on 'What could possibly go wrong in transfer pricing? Navigating the challenges and pitfalls', with Michael Kobetsky, Member of the United Nations Sub-Committee on Transfer Pricing. The panel unpacked some of the practical challenges that can arise when managing transfer pricing positions and steps that can be taken to mitigate risk. Some key points from the discussion: • there are a broad range of things that can go wrong, but a common driver is a lack of consistency (e.g. in data, reports, public disclosures and/or evidence); • there is tension between the need to maintain consistency and navigate through changes (internal and external); and • establishing frameworks and processes that drive consistency, but specifically contemplate change or variation help protect against these risks. #TPMinds #transferpricing #tax
