Viable Placemaking are thrilled to have won an extremely controversial CIL case, in which a self-build homeowner was left with over £20k charges following the passing of their husband. This case raised several intrinsic questions including 'what is the relationship between Regulations 65 (1) and (3)?' and 'what are the implications of Regulation 37(1), which stands along within the assumption of liability context?' Following extensive review by the Council's legal team, it was confirmed that there was no CIL to pay. In October, BCIS published the updated CIL index figure for 2025, which is 391. Although this is only a 2.6% increase from 2024, it is over 17.7% since 2022. Clearly, the index rate has risen substantially in recent years and this has the potential to greatly impact the costs and viability of many schemes.
