📢New requirement for businesses: ensuring all tips are paid to employees! The Department of Business and Trade has published a code of practice on fair and transparent tip distribution, and we’re here to help you ensure your business is compliant. Here’s a quick rundown: 1. If your business has employees earning National Minimum Wage, keep in mind that tips don’t count toward their minimum wage. However, tax still applies to any tips they receive. 2. When tips are distributed by the business owner or another person directly involved in running the business, these tips are subject to both Tax and National Insurance. 3. However, a business can appoint a Troncmaster, this could be a head waiter or chef who isn’t involved in the daily running of the business. The Troncmaster would handle tip distribution, deciding who gets tips and how much. With a Troncmaster formally agreed by HMRC, tips are only subject to tax (and not National Insurance), through payroll.
