How would you handle a tenant who consistently pays late despite repeated reminders and notices?

While evaluating the situation, it is very important to determine whether the reasons for late payment derive from a specific adverse situation, or whether it is a "modus operandi" of the tenant. In countries where the legal consequences for late payment are few and slow comming, tenants may develop unhealthy and unfair commercial practices towards owners. Such practices may include using the rent for other purposes and paying the rent at the end of the period, instead of within the time frame provided for in the lease agreement.

This is where it is critical to have a strong property manager on your side as a landlord. Generally speaking, there are state laws, protocols and processes that must be followed in order to deal with late tenant payments. A great property manager will proactively communicate with you the actions they have taken to address the issue and put forward options for your consideration. In my experience, if a tenant is consistently paying late, I would reconsider seeking new tenants. Provided formal communication and the required number of notices have been provided to the tenant, you should be able to terminate the lease agreement due to a breach and send them a notice to vacate.

The first thing that is obvious is that the many notices are not achieving anything. There is obviously a real issue that needs to be discovered and this takes place by talking to people. The Landlord should be concerned as it could indicate financial sustainability problems. Working out a collaborative plan to resolve if possible should be done in conjunction with whatever legal processes you want to follow.

In my experience car troubles and health issues have been problematic. Taking partial payments and offering a weekly or biweekly payments helped. Obviously offering to everyone in case there was ever an instance of a fair housing allegation

When reminders fail to resolve the issue, it's time to send formal notices. A "Pay or Quit" notice is a formal document that gives tenants a specific timeframe to pay overdue rent or face potential eviction proceedings. This notice should be drafted and delivered according to your state's legal requirements. The seriousness of a formal notice often prompts tenants to address their payment delinquencies promptly to avoid further consequences. By taking this structured and legal approach, you emphasize the importance of timely rent payments and protect the financial health of your property management business.

Eviction should not be considered the last step. This step should be "filing in court for eviction." Once the Tenant has notice its been filed, some, but not all, will pay, reinstate, and change their ways, if the Landlord permits. So, filing in court doesn't have to always result in eviction, but can convince the tenant to cure the problem. Although legal fees are not cheap, turning over a rental unit involves vacancy time, painting, cleaning, advertising, repairs and administrative time that probably exceed the legal fee to file and dismiss an eviction case. So, this step can be part of the process of fixing the issue instead of just giving up on a current tenant.
