💰 TD Bank faces significant challenges as it pleads guilty to money laundering, agreeing to pay $3bn in penalties. With a $434bn asset cap imposed by the OCC, TD’s US growth plans are on hold, and its 2025 pre-tax net interest income could drop by $225mn. 💼 The penalties, including restrictions on new branches and dividends, come after multiple investigations revealed failures in monitoring $18.3tn in customer transactions, enabling laundering of $670mn. 📉 TD is now planning a 10% reduction in US assets to comply with regulatory limits. Here's my round up 🔎The current state of the nation of fraud presented by Jonathan Fisher QC. A noteworthy point was around the role of whistle blowers in enabling prosecution 🔎The CIFAS pledges that Helena Wood reminded us of 🔎Operation Hen House, EMMA (European Money Mule Action) and how criminals were brought to justice by Nik Adams and oliver little. We can never tire of the ispoof videos! A highlight for me was to hear about the success of Operation Haechi, with cooperation across 30 jurisdictions. One country cannot do this on its own 🔎The different types of fraud cases by Mark Lucraft KC - Complex fraud (brought by SFO), government benefits and grant fraud, Financial Institution fraud, organised and sporadic fraud - and the resourcing challenges 🔎The two types of victims, those who get their funds stolen presented by Katie Kemp and those who are trapped by human traffickers and set up to defraud by Mina Chiang 🔎The role of social media, what is being done and how much more could be done 🔎Data and intelligence sharing, or perhaps "model sharing" proposed by Mike Dewar 🔎APP fraud reimbursement scheme and shining the torch on victims - 18% of fraud victims are repeat victims and make 35% of fraud claims! Wow! 💡IF there was one theme that came up consistently it was risk assessment. OFCOM expects social media firms to conduct a fraud risk assessment. Sharing data meaningfully requires an appropriate fraud risk assessment. Victim organisations want firms to consider victims as part of their fraud risk assessment. In defence of the "failure to prevent fraud offence", organisations are advised to conduct a fraud risk assessment. Watch this space for more to come from ACAMS!
