Federal agencies derive much of their power from interpreting and implementing laws passed by Congress. Named for a 1984 case, Chevron allowed agencies to interpret uncertain provisions in those laws using a two-part test: (1) determine whether Congress has already spoken on the issue; and (2) if not, decide if the statute is ambiguous or silent, and therefore open to reasonable interpretation. While supporters argued that Chevron provided necessary flexibility and applied expertise to policymaking, critics claimed it gave federal agencies too much power, leading to overreach and inconsistent enforcement. For National #WorkzoneAwarenessWeek, we partnered with the Associated General Contractors of Texas to produce a short video on the importance of paying attention and refraining from Tailgating in our Texas Workzones. The last deathless day on Texas Highways was November 7th, of 2000 so we all need to do our part in TXDOT’s #EndTheStreak initiative especially in our workzones.

ICYMI: Texas Lieutenant Governor Dan Patrick released the interim charges to Texas Senate Committees yesterday. These are the committees' homework assignments ahead of the 89th Legislative Session. On the environmental front, the Senate Committee on Natural Resources and Economic Development has been charged with studying federal interference in the Texas economy (citing the LNG export ban as an example), as well as cement plant permitting. The Water, Agriculture, and Rural Affairs Committee will be studying how Texas agencies with a hand in water issues coordinate with each other. Expect a handful of hearings over the summer. Work zone safety is a year-round concern. Last year, there were 26,000 traffic crashes resulting in the tragic loss of 190 lives. Happy 100th birthday to Texas Department of Transportation's Maintenance and Construction Divisions! 🎉 “A lot has changed since 1923,” said Construction Division Director Duane Milligan. “We don’t use horses on our projects anymore or as much manual labor. Our construction projects have seen incredible advances in technology. But from the beginning, we’ve had a commitment to the safety of our employees.” “In 1928, the division had 18,000 highway miles and 10,000 of those miles were just plain dirt,” said Maintenance Division Director James Stevenson. “Today we maintain more than 200,000 lane miles of pavement.” Read more 👇
