The Supreme Court May Have Just Legalized CBD in Food and Beverage Across the USA Buckle up, because the Supreme Court might've just drop-kicked the FDA's authority to keep CBD out of your morning coffee and afternoon snack. The "Loper" ruling made at the end of June could be a big deal for the CBD industry and may change everything in food and beverage. SCOTUS basically said that federal agencies like the FDA can’t go beyond what the law explicitly says. They overturned decades of what's known as "Chevron deference," which let government agencies interpret laws. Remember the 2018 Farm Bill? It legalized hemp-based CBD with less than 0.3% THC. The text is clear: CBD is legal nationwide. But the FDA still banned CBD in food and drinks, dragging their feet on issuing any new guidance despite pressure from Congress and industry. It’s only a matter of time before someone challenges the FDA’s stance on this, and they’ll probably win. This could open the floodgates for CBD products in the food and beverage market.
