    The Supreme Court May Have Just Legalized CBD in Food and Beverage Across the USA Buckle up, because the Supreme Court might've just drop-kicked the FDA's authority to keep CBD out of your morning coffee and afternoon snack. The "Loper" ruling made at the end of June could be a big deal for the CBD industry and may change everything in food and beverage. SCOTUS basically said that federal agencies like the FDA can’t go beyond what the law explicitly says. They overturned decades of what's known as "Chevron deference," which let government agencies interpret laws. Remember the 2018 Farm Bill? It legalized hemp-based CBD with less than 0.3% THC. The text is clear: CBD is legal nationwide. But the FDA still banned CBD in food and drinks, dragging their feet on issuing any new guidance despite pressure from Congress and industry. Consumers are really interested in CBD-infused food and drinks and lots of big brands and restaurant chains are ready to roll out these products as soon as they get the green light. Some states have already allowed CBD in food and drinks, and it’s been selling well with no major  issues. Other countries are also on board. Thanks to the Loper ruling, the FDA might not have the power to ban CBD in food and drinks anymore and the courts said the FDA can't have unilateral power to interpret. It’s only a matter of time before someone challenges the FDA’s stance on this, and they’ll probably win. This could open the floodgates for CBD products in the food and beverage market. As someone deeply involved in the health and wellness space, I’ve seen the potential of CBD firsthand. This ruling is a game-changer for consumers and businesses alike.     From our CEO Chuck Siegel: Independent research we’ve conducted into the consumer appeal of functional foods and beverages has revealed some fascinating nuggets, and I’d like to share some. The most obvious and irrefutable insight is that consumer interest is already strong, and it’s rising quickly. We asked 1,000 US adults last April “How appealing is the idea of well-known food and beverage brands adding functional ingredients to products you consume on a daily or regular basis?” and 54% said appealing or very appealing. Four months later, in August, a separate sample of 1,000 US adults, 61% answered the same question that functional ingredients are appealing or very appealing, representing an increase of 11%. Think about that. Over half of American consumers find the idea of functional foods and beverages appealing (or *very* appealing!), and interest is growing rapidly. Yet it’s hard to think of many existing examples in the marketplace. There’s orange juice with added calcium, and yogurt with probiotics, and not many others.
