It's time for licensed Financial Advice Providers (FAPs) to prepare and submit their annual regulatory returns. Returns must be submitted by 30 September for the 12-month period to 30 June. The FMA have published an information sheet to help FAPs complete their returns.
All licensed Financial Advice Providers (FAP) are required to complete and submit an annual regulatory return. This is a series of questions to obtain an up-to-date understanding of the nature, size and complexity of financial advice provider services. Licensees will be required to complete an annual regulatory return for the 12-month period ending 30 June and submit it to the FMA by 30 September. All licenced FAPs have been notified via e-mail to submit their regulatory return by 30 September 2024. To familiarise yourself with questions for the FAP regulatory returns you can download our FAP regulatory return information sheet: https://lnkd.in/gZrGeuKk. Please note that this information sheet is a collection of existing information on regulatory returns, in a single document for your ease and convenience. It contains no new information or expectations for FAPs. We expect it will be useful for FAPs when completing the regulatory return using the online form. The FMA has released its first insights report into supervision activities and monitoring of the Financial Advice Provider (FAP) sector. The report highlights that FAPs and financial advisers have generally made good progress in transitioning to the new requirements. The FMA commented that they have seen FAPs using the new requirements to further serve the needs of their clients and build stronger and more resilient businesses. But the FMA also emphasised the need to avoid a 'tick the box' approach to compliance. They identified gaps that, if they remain unchecked, could escalate into poor outcomes for clients. Everyone can learn from these insights. FAPs and financial advisers should assess and improve their operations to align with the overarching objective to serve the needs of clients and invest the effort and time to ensure their arrangements are fit to achieve this.
