I have to comply with what???!!!! The Department of Labor's (DOL's) Office of Federal Contract Compliance Programs (OFCCP) created the Contractor Portal for the 2024 Affirmative Action Program (AAP) certification on April 1, 2024. This Certification is required by July 1, 2024 for all covered Federal contractors and subcontractors to certify their AAP compliance. Covered Federal contractors and subcontractors are required to utilize the portal to certify, on an annual basis, and certify they have developed, implemented and maintained an AAP for each establishment and/or functional/business unit, as applicable. Any new contractors have 120 days to develop their AAP(s) and must register and certify compliance through the Contractor Portal within 90 days of developing their AAP(s). As we previously mentioned earlier that there is an proposed amendment presented before the Senate regarding the 2025 National Defense Authorization Act. Which would significantly increase the ability of federal Contracting Officers to award sole source contracts to WOSBs, HUBZones and SDVOSBs. The proposed amendment would eliminate the “rule of two” restriction, under which a Contracting Officer can only award a sole source contract under these programs’ authority if the Contracting Officer does not expect to receive two or more offers. BLUF, the amendment would allow sole source awards under the applicable dollar thresholds regardless of competitive potential, which very similar to the 8(a) program. Current trends demonstrate the 8(a) Program accounted for more than 95 percent of “SBA” sole source dollars awarded in FY 2023. In accordance with the limitations on subcontracting, as stated in FAR 52.219-14, “an independent contractor shall be considered a subcontractor.” Considering my experience in both serving as a US Government official and Key stakeholder, small prime contractors often times assume that independent contractors count toward the prime’s self-performance, however in the government’s eyes, an independent contractor is a “subcontractor of one,” and not inclusive as part of the prime contractors workforce.
