Bates White supported expert Robin Lee on behalf of the Department of Justice in second US v. Google antitrust case. The case is a civil antitrust suit that alleges Google violated sections of the Sherman Act. The DOJ claims that Google unlawfully monopolized markets for publisher ad servers, ad exchanges, and advertiser ad networks for open-web display advertising. It alleges that this harmed competition and innovation and raised transaction prices. At trial, Dr. Lee testified on market definition, market power, and Google’s exclusionary conduct. The case garnered significant media interest, including Law360 and The Wall Street Journal. A decision is expected in late 2024 or early 2025. Partner Glenn George testified at trial in In re The Financial Oversight and Management Board for Puerto Rico (FOMB), as representative of Puerto Rico Electric Power Authority (PREPA), Debtor. This is an $8.5 billion Puerto Rico Oversight, Management, and Economic Stability Act Title III bankruptcy matter in the US District Court for the District of Puerto Rico. Dr. George’s work was in support of FOMB's proposed Plan of Adjustment with respect to a proposed Legacy Change to service new bonds issued to creditors of PREPA.
