Congratulations to BBS member, Jim Blumenthal, who won a defense verdict in a jury trial in Atlantic County, New Jersey. Jim defended a company whose employee rear-ended the plaintiff in traffic. The plaintiff alleged spinal disc injuries and underwent a cervical discectomy and fusion surgery. The plaintiff’s operating neurosurgeon testified at trial that the plaintiff suffered disabling injuries caused in the accident and that the plaintiff would require two additional future surgeries at the cost of $350,000. Plaintiff’s counsel’s settlement demand was $600,000 and an offer to take judgment was filed in this amount. The defense countered with a neuroradiologist who reviewed the plaintiff’s diagnostic imaging studies and testified that there was no imaging evidence of a traumatic injury. Notwithstanding that this was a “zero tort threshold” case, the jury returned with a unanimous defense verdict finding that the defendant’s negligence was not the proximate cause of the plaintiff’s injuries, and no damages were awarded to the plaintiff. Congratulations Jim!!
