Wow - a big update on the FTC's noncompete ban! On Tuesday, Judge Brown (Texas) entered a final order invalidating the rule and setting it aside. Read all about it below.
FTC noncompete ban update: a lot has happened in the last week! Last Wednesday, a Florida judge preliminarily found the FTC's rule invalid based on the Supreme Court's major questions doctrine. Today, Judge Brown in Texas, who had already preliminarily found the rule invalid, entered a final order invalidating the rule and setting it aside.

We love our growing family and are so happy to welcome Ashley Bowcott back to BFV.
Today is my first day back to work since being out on maternity leave this summer after I had my son. Happy to be back in the office and grateful for my firm Berman Fink Van Horn P.C. and clients for their patience & flexibility as I navigate this new phase of life. Also thankful for supportive organizations like Georgia Association For Women Lawyers as I was able to continue attending our monthly mentor circle dinners with baby Jameson in tow! Being a full time working mom will no doubt come with its challenges, but I'm as ready as I'll ever be.

Please see my colleague Olivia Landrum's blog discussing an opinion from the Eleventh Circuit Court of Appeals on a significant procedural issue. Specifically, the decision clarifies and broadens the materials courts may consider when adjudicating motions to dismiss. This ruling may make it easier for defendants to obtain dismissals of lawsuits at the early pleading stage.
