BIO is warning that payers may be playing games with the implementation of the IRA in a way that threatens both patient access and the sustainability of emerging biotech companies. The IRA required biopharma manufacturers to pay larger rebates for certain medicines as part of benefit design changes under Medicare Part D. Because that would be especially disruptive for smaller companies, the law phased in those rebates more slowly for those firms. But payers are now demanding rebates of their own from those protected companies, prompting BIO to ask CMS to pay closer attention to formulary placement and access restrictions from Part D plans. https://lnkd.in/dipG3Afj
