The Industrial Property Court (TPI) in Chile has ruled in favor of the Taiwanese company MICRO-STAR INT’L CO., LTD. (MSI), allowing them to retain their trademark “META READY” despite objections from Meta Platforms, Inc., the parent company of Facebook. The National Institute of Industrial Property (INAPI) had initially rejected MSI's application for “META READY” due to a potential risk of confusion with Meta’s existing “META” trademark. MSI, represented by Andes IP and attorneys Andrea Lobos and Fernanda Olmedo, successfully appealed this decision. MSI argued that the term “META” is descriptive and commonly used in computing and virtual reality contexts, such as metadata and metaverse, reducing its distinctiveness. They pointed out that “META READY” is distinguishable due to its unique combination and is unlikely to confuse consumers. The TPI agreed, noting that other trademarks in Class 9, like “METACLOUD” and “METASYS,” coexist with Meta’s without causing confusion. This ruling demonstrates the limited protection of Meta Platforms’ trademark in contexts where “META” is considered descriptive.
