The Thought Leader Summit promises a rich lineup of educational programming at both venues - including two CLE sessions - with fellow practitioners, in-house counsel, industry experts, and judges from the Patent Trial and Appeal Board (PTAB). This will include a panel discussion in Virginia that will be livestreamed to California, followed by in-person keynote addresses and engaging round table discussions at both locations. Brooks Kushman has been an Early Adopter of the program, achieving and remaining certified since the initial launch of the Midsize program in 2020. Participating firms commit to the core principles of transparency, accountability, and knowledge sharing to achieve Mansfield Certification. While over 360 firms earned Mansfield Certification this period, only about half of those including Brooks Kushman opted into Certification Plus. In a precedential decision, the U.S. Court of Appeals for the Federal Circuit recently breathed new life into a set of medical device patents previously deemed invalid. At the heart of the dispute was the interpretation of a particular phrase used in the patents at issue: "substantially rigid portion." What began as a technical disagreement over the rigidity of catheter segments broadened into a dispute about how patent claims should be construed and whether different claims within the same patent family can describe the same invention in varying ways. The Federal Circuit's analysis reflects a nuanced, less restrictive approach to claim construction. By focusing on the functional aspects of claim limitations and allowing for flexibility in how inventions are described across multiple claims, the court's reasoning provides a framework for interpreting claims that balances the need for clarity with the need for flexibility during the patent drafting stage.
